‘Seditious remarks': HC grants anticipatory bail to filmmaker Akhil Marar
Kochi: Kerala high court has granted anticipatory bail to filmmaker and Bigg Boss Malayalam Season 5 winner Akhil Marar in connection with a case registered against him for alleged seditious remarks concerning the Pahalgam attack and the India-Pakistan border truce. Justice Bechu Kurian Thomas, who heard the matter, directed Marar to appear before the investigating officer at 10am on June 10 for interrogation and to surrender his mobile phone. The court ordered that if arrested, he shall be released on bail. The case, registered by the Kottarakkara police under Section 152 of BNS, pertains to a Facebook video allegedly posted by Marar with content deemed threatening to the sovereignty and integrity of India. Marar argued that the allegations were false and politically motivated, and that the post was deleted within an hour of being uploaded upon realising the potential for misuse. The prosecution opposed the plea, asserting the need for custodial interrogation and device seizure. On examining the materials, the court noted that Article 19(1)(a) guarantees freedom of speech and expression and that this freedom can only be curtailed by reasonable restrictions under Article 19(2). Prima facie, the court found that the Facebook post, lacking any direct incitement to armed rebellion or secession, did not amount to such incitement by itself.

HC restraint on arrest of Akhil Marar
The Kerala High Court on Tuesday directed the police not to arrest filmmaker and social media influence Akhil Marar till May 28, the next date of hearing of his petition seeking anticipatory bail in a case registered against him for allegedly making anti-national remarks in a video shared on social media. He has been booked for the offence Section 152 (act endangering sovereignty, unity and integrity of India) of the Bharatiya Nyaya Sanhita. When his petition came up for hearing, Justice Bechu Kurian Thomas also sought the response of the police to his anticipatory bail petition. In his petition, he denied having made any statements affecting the integrity or sovereignty of the nation and that the video was only a political analysis. The remarks were made in response to a mocking post by another television journalist. In fact, he had removed the video when he realised that it could be misinterpreted.

Thiruvananthapuram: Kottarakkara Police registered a case for treason against television personality and social media influencer Akhil Marar on Tuesday night. Since the charge against him is non-bailable, he will be produced before a court, which may remand him," said police.
