Judge allows new evidence in Adam Asmuni's bid to reclaim luxury items

KUALA LUMPUR: Former Bersatu Youth chief Adam Asmuni has been granted permission to introduce fresh evidence in his appeal against the forfeiture of a luxury vehicle and several high-value items seized during a drug raid. High Court Judge K. Muniandy granted the application after hearing submissions from Adam's counsel, Amirrul Jamaluddin, and deputy public prosecutor Mohamad Shahrizat Amadan today. The new evidence comes in the form of bank account statements belonging to Adam's company Percetakan Alfa Gemilang between 2014 and 2019. Amirrul submitted that the financial records were vital to support his client's appeal against the Sessions Court's forfeiture order, issued on March 14 last year under Section 32(2) of the Dangerous Drugs (Forfeiture of Property) Act 1988. "The bank statements are relevant as they demonstrate my client's legitimate source of income derived from business operations under Percetakan Alfa Gemilang. "The company secured multi-million ringgit government tenders, and the assets in question were acquired lawfully," he said. He added that the documents could not be obtained during the original forfeiture proceedings, which justified their admission at this appeal stage. However, Shahrizat objected to the application, arguing that the documents ought to have been produced during the initial trial at the lower court two years ago. Justice Muniandy fixed June 30 for the hearing of the substantive appeal. On March 14, 2023, Sessions Court Judge Nor Hasniah Ab Razak rejected the bid by Adam and his wife, Lyiana Roslee, to recover two luxury cars, several other vehicles, a motorcycle, cash, luxury watches, designer handbags, laptops, jewellery, and multiple Amanah Saham Nasional Berhad (ASNB) accounts. In January this year, Adam was sentenced to seven years' imprisonment and 10 strokes of the cane by the Shah Alam High Court after pleading guilty to an alternative charge of possessing cannabis. He is currently serving his sentence at Kajang Prison. Lyiana was discharged and acquitted after the prosecution withdrew the charge against her.

PETALING JAYA: The Court of Appeal has fixed June 25 to deliver its decision on Muar MP Syed Saddiq Syed Abdul Rahman's appeal against his conviction and sentence for criminal breach of trust (CBT) and money laundering. Deputy public prosecutor Wan Shaharuddin Wan Ladin said the date was set during case management today, Berita Harian reported. A three-member Court of Appeal panel chaired by Justice Ahmad Zaidi Ibrahim had heard submissions from the prosecution and defence over three days. In November 2023, Syed Saddiq was found guilty of abetting in CBT involving more than RM1 million belonging to Bersatu Youth, and another count of dishonest misappropriation of property totalling more than RM120,000 also belonging to the wing. The former Bersatu Youth chief was also convicted on two counts of money laundering for transferring a total of RM100,000 to his personal account from a company, Armada Bumi Bersatu Enterprise, linked to the youth wing. The High Court imposed a three-year jail term and ordered that Syed Saddiq receive one stroke of the rotan. The Muda founder was also sentenced to two years in jail and another stroke of the cane for the misappropriation charge and an additional two-year term behind bars for each of the money laundering offences. He was also fined RM10 million. The court ordered that the jail terms for CBT and dishonest misappropriation run consecutively, and for those handed down for money laundering offences to run concurrently. As a result, Syed Saddiq would have to serve seven years in jail. KUALA LUMPUR, April 24 — Muar MP Syed Saddiq Abdul Rahman will find out on June 25 whether he succeeds in overturning his conviction and sentence for criminal breach of trust (CBT), misappropriation of property, and money laundering. The Court of Appeal fixed the date during case management today, according to deputy public prosecutor Datuk Wan Shaharuddin Wan Ladin. The former youth and sports minister, 33, was sentenced in November 2023 to seven years' jail, two strokes of the rotan, and a RM10 million fine after being found guilty on four charges linked to his time as Bersatu Youth chief. Among the charges: abetting CBT involving RM1 million from Bersatu Youth (Armada) funds, misusing RM120,000 from an Armada Bumi Bersatu Enterprise account, and laundering RM100,000 in illicit proceeds. The appeal was heard by a three-judge panel led by Datuk Ahmad Zaidi Ibrahim, with both sides presenting submissions over three days. If the appeal is allowed, Syed Saddiq will walk free — though prosecutors can still take the case to the Federal Court. If the appeal is dismissed, the Federal Court remains his final legal recourse.
