Shamsubahrin acquitted of RM300,000 cheating charge over mall contract
KUALA LUMPUR: Big Blue Taxi Services founder Datuk Shamsubahrin Ismail has been acquitted of a cheating charge involving a RM300,000 mall security contract six years ago. High Court judge K. Muniandy made the ruling after allowing the 59-year-old's appeal to set aside the conviction and the three-year jail sentence imposed by the Sessions Court on Sept 20, 2023. "The trial judge had wrongly found that the said contract did not exist, despite prosecution witnesses testifying that a contract had been arranged but later cancelled by the KLCC authorities. "The cancellation of the contract was beyond the appellant's control and should not have been construed as deceit. "The trial judge failed to consider the fact that the complainant's company did not take the necessary steps to comply with the registration procedures and failed to submit the required documents. "Accordingly, the appeal is allowed, the conviction is set aside, and the accused is acquitted and discharged of the charge under Section 420 of the Penal Code," the court said. Muniandy also said the prosecution had failed to establish the element of mens rea (the guilty state of mind required to prove a cheating offence) either in the charge or in court. "The Sessions Court judge erred in failing to find whether the mens rea was proven. "Based on the evidence and the legal principles applicable, this court exercises its appellate powers to correct the miscarriage of justice that has occurred. "The conviction and finding of guilt against the appellant were not based on the available evidence nor the applicable law," he added. Shamsubahrin had been charged in April 2021 with cheating businessman Izham Ramli, 37, by deceiving him into believing that he could secure a security contract at KLCC within 30 days. The alleged deception prompted the complainant to transfer RM300,000 into a bank account under the name of legal firm Tetuan Muhammad Zahir at a restaurant in KLCC in early October 2019. Shamsubahrin was represented by lawyer Zulkifli Awang while deputy public prosecutor Izalina Abdullah prosecuted. On Sept 20, 2023, the Sessions Court convicted Shamsubahrin and sentenced him to three years in prison.
