JOHANNESBURG - The defence lawyer for a man accused of raping and impregnating an 11-year-old girl has attempted to poke holes in the testimony of the officer investigating the case. Frik van Rensburg posed several questions to the investigating officer, who submitted that the accused Ugandan man could be a flight risk. The man is alleged to have raped the minor in December last year. Is the denial of an alleged rape equivalent to lying about the offence? This was one of the questions that the Boksburg Magistrates Court grappled with as the man accused of raping an 11-year-old girl continued his quest for bail. Investigating officer, Simon Modise, took the stand and was met with a barrage of questions from the man's defence lawyer, Van Rensburg, who questioned Modise about the child's initial denial that she'd had sex when questioned by her Rensburg: "You, in your own words, testified now that she denied it. The mother then told the child: 'Tell me the truth', after which it was admitted. That's your testimony."Modise: "Your worship?" Van Rensburg: "Sir, I asked you if that's your testimony. Yes or no? It's easy."

OHANNESBURG - The investigating officer in the rape case of an 11-year-old girl has submitted their opposition to the release of the man accused of impregnating her on bail. He believes the 29-year-old man, who is a Ugandan national, may flee the country if released. The man made another appearance before the Boksburg Magistrates Court on Thursday, where the details of the multiple rapes were submitted before the lower court. It's alleged that the man has been raping the little girl since she was six until she fell pregnant after the last incident in December 2024. The investigating officer's affidavit was read before the court by prosecutor Kagiso Ralethata. "The accused person is from Uganda and he is legal in South Africa. He has ties, family and financial, however, given the gravity of this particular offence, he may have an incentive to leave trial and go back home." The victim's family and community have pleaded with the court not to release the man on bail, something that was submitted to the court by the investigating officer as a factor that could disturb public peace or undermine public order or security. "There is public outcry in the matter. There is evidence that shows that people are protesting against the release of the accused and there is also a petition from the community."

JOHANNESBURG - Two petitions have been filed before the Boksburg Magistrates Court against granting bail to a man accused of raping and impregnating a minor. The 28-year-old suspect on Thursday continued his fight for bail before the lower court. During the appearance, the details of the rape of the 11-year-old child was laid bare, angering the gallery in the court, which was filled with the child's family and community. The suspect faces one count of rape, which is a schedule six offence and requires that he demonstrate exceptional circumstances for his release on bail. On 21 April, Naledi, which is not the minor's real name, was with her mother when the change in her body first became apparent. When asked if she had ever had sex before, the young girl said no, but after several pleas, Naledi broke her silence. She named what she called her brother as the man who allegedly raped her. The details of one of the incidents was contained in the investigating officer's affidavit, which was read before the court by prosecutor, Kagiso Ralethata. "She said that she was sleeping in one room with him and on the same bed and the accused started touching her breasts and requested her to remove her pyjamas and panty." The two petitions by the Germiston Ugandan community are pleading with the court for the man to remain in custody.

JOHANNESBURG - The Boksburg Magistrates Court will on Thursday continue hearing the bail application of a 28-year-old man accused of raping and impregnating a minor. The man, who is a close family friend to the victim, is alleged to have raped the young girl in December 2024. The child is now four months pregnant and has been removed from school as she unwillingly prepares to be a mother. The suspect's bail was partly heard earlier in May but has faced several delays. During previous court appearances before the lower court, the accused avoided eye contact, tilted his head slightly, and fixed his eyes just above the magistrate. His demeanour is one of no emotion, and he can only be heard when responding to the presiding officer's questions on language preference. He's accused of a Schedule Six offence – the most serious in terms of the Criminal Procedure Act – which requires that he demonstrate exceptional circumstances for his release. The rape accused will be illustrating these in his continued fight for bail on Thursday, about a month after his arrest.
