Chhattisgarh HC seeks govt reply on plea for 10% EWS quota implementation

Chhattisgarh HC RAIPUR: The Chhattisgarh HC has directed the state government to file a reply within four weeks to a petition seeking implementation of the Economically Weaker Sections (EWS) reservation in government services. The petitioner has been asked to submit a rejoinder within two weeks thereafter. Petitioner Pushparaj Singh filed a writ petition through counsel Yogesh Chandra, stating that while other states have implemented 10% reservation for the EWS general category in public employment, Chhattisgarh is yet to do so, despite the Chhattisgarh Public Service Ordinance, 2019, already being in effect. Justice Amitesh Kishore Prasad's single bench heard the matter. The court was informed that Articles 15 and 16 of the Constitution of India were amended on 12 January 2019, empowering states to provide 10% reservation to the EWS category. The Union of India implemented this 10% EWS reservation on 19 January 2019. Subsequently, Section 4 of the ordinance and Public Service Amendment Ordinance issued by the Chhattisgarh government on 4 September 2019, proposed 10% reservation for the economically weaker sections. The petitioners had also submitted a representation in this regard on 29 April 2024. During the hearing, the counsel argued that based on the constitutional amendment, which empowers state governments to provide EWS reservation, it has been implemented in other Indian states, including Madhya Pradesh and Rajasthan. Individuals belonging to the EWS category are entitled to a maximum of 10% reservation in public employment as per the constitutional amendment. After arguments, the High Court directed the state government to file its reply within four weeks, following which the petitioner will have two weeks to submit a rejoinder. The next hearing will be scheduled after this. Meanwhile, petitioners' counsel Yogesh Chandra informed a media outlet that the High Court had ordered the state government to file its response by 28 March 2025, and four weeks have since passed. The state government is yet to file its reply, the counsel said.

Raipur: The National Lok Adalat held on Saturday across the state, from the High Court to the Taluka level and revenue courts, resulted in the resolution of 38,98,415 cases, with awards totalling Rs 593 crore. Chhattisgarh HC Chief Justice and Chhattisgarh State Legal Services Authority (CGSLSA) Patron-in-Chief Ramesh Sinha connected virtually with all 23 districts from HC. This was to assess the progress and monitor the advancement of the second National Lok Adalat of the Chief Justice conducted a virtual inspection of the National Lok Adalat proceedings and interacted with principal district judges. He encouraged them to ensure the successful resolution of disputes. The chief justice stated that the National Lok Adalat offers a platform for litigants to resolve their disputes amicably and quickly. The Chhattisgarh government has announced that primary school teachers who lost their jobs on the back of a high court ruling last year will be rehired as assistant teachers in government school science laboratories. The decision, taken at a cabinet meeting Wednesday, came after months of protests by Bachelor in Education (B.E.d.)-trained teachers, who lost their jobs following the Chhattisgarh HC's April 2024 ruling. In its order, the HC quashed a 2023 notification from the National Council for Teacher Education (NCTE) requiring primary teachers to have a degree. Instead, the court held that a Diploma in Elementary Education ( was the qualification needed for the position. The ruling meant that appointments of over 2,500 primary school teachers would be annulled. Announcing the cabinet decision on X Wednesday, Chhattisgarh's Finance Minister O P Choudhary described it as a 'historic decision'. 'Adjustment of 2,621 qualified Assistant Teachers to the post of Assistant Teacher Science (Laboratory) who have retired from service in Direct Recruitment 2023,' the post said. The protesters have welcomed the decision. 'We want to thank the Chief Minister Vishnu Deo Sai and the government. We also want to thank the opposition (Congress party) as well and to all the social organizations that stood with us and the media for giving our protests wide coverage,' Vikas Mishra, one of the teachers leading the campaign, told The Indian Express. In April last year, the Chhattisgarh HC declared the September 2023 appointment of teachers null and void, instead holding Diploma in Elementary Education ( to be the primary qualification needed for such appointments in primary schools. The ruling was eventually upheld by the Supreme Court in September. In January – days after the HC voiced its displeasure at the state government's delay in appointing teachers – the Vishnu Deo Sai dispensation began issuing termination letters to teachers, leading protesters to intensify their agitation, with 30 teachers courting arrest.
