Harvey Weinstein NYC Rape Trial Jury Seated With Female Majority; Opening Statements Wednesday
Harvey Weinstein's latest New York rape trial will see opening statement tomorrow now a jury has finally been chosen. With the last alternate picked Tuesday after over a week of selection of literally hundreds of people, the much accused Pulp Fiction producer will plead his fate to a panel of seven women and five men as well as five alternates. There is also now one additional count of Criminal Sexual Act in the First Degree, which was added to the indictment last September. If found guilty again, under a new judge, Weinstein will likely spend the rest of his life behind bars. Today, Weinstein's reps charcterized the selection of a jury and the trial about to begin as a new era for their client. 'It was a rigorous and at times grueling process, but we believe the jury selected is one that can assess the facts with clarity and impartiality,' Juda Engelmayer told Deadline just after the jury was seated. 'We are hopeful that this time, the legal process will rise above noise and narrative, and allow Harvey Weinstein the fair trial he's long been denied. He deserves the chance to clear his name and preserve a legacy that has been overshadowed by deeply flawed and misleading accusations.' All of the jurors are native New Yorkers with the exception of three. One, the foreman, is gentleman who was born in the Dominican Republic and came to NYC in 1996. There is another male from the Dominican Republic, who has been living in New York since 2000, and there is also a man who moved from the state of Georgia to New York in 2013. As he has in every one of the dozens and dozens of accusations against him since 2017 and the New York Times expose of his decades of misconduct and alleged assaults, Weinstein has said in this matter that he is innocent, that the interactions were all consensual and he is being stitched up. In a surprise to many and a sign of the waning #MeToo movement, a 4-3 panel of New York appeals court judges a year ago dismissed the 2020 conviction on the grounds prosecutors had misstepped by allowing the testimony of other Weinstein accusers whose claims were not being tried. Still, the one time mogul stayed incarcerated during the lead up to this trial because of his 2022 conviction in Los Angeles on sex crimes and sentencing to 16 years, which is now also under appeal. Throughout the entire pre-retrial process, Weinstein's health and conditions at Rikers have been constant concerns In January the ex-producer implored the judge now overseeing the NYC case, Curtis Farber, to move the trial up. 'I'm asking you, and begging you,' Weinstein said. 'Every week counts. I'm holding on because I want justice for myself. I want this to be over.' Weinstein representatives claimed he nearly died while in custody at the jail he called a 'hellhole.' The trial date didn't change, but Judge Farber is allowing the wheelchair bound Weinstein to remain in custody at Bellevue Hospital for the duration of the trial instead of having to return to Rikers every evening. In court, Weinstein will face two of the same accusers whose testimony paved the way for his conviction before it was thrown out on appeal: Jessica Mann and Mimi Haley. For the retrial, the Manhattan District Attorney has added a new charge based on the claim of an unnamed woman who is expected to testify that Weinstein sexually assaulted her in a Manhattan hotel room in 2006. Other Weinstein accusers who testified in the first trial as supporting prosecution witnesses, but without charges attached to their accusations, will not return to the stand this time around. That un-charged testimony was the basis of the appeals court decision throwing out Weinstein's conviction. In other court matters, Weinstein is suing his brother and ex-business partner Bob Weinstein and former COO David Glasser over an old $45 million loan that was supposed to save the now shuttered The Weinstein Company in 2016. As well, Weinstein has an ongoing $5 million suit against New York over 'deplorable' conditions at Rikers. Out in LA, Weinstein had a rare court win of sorts in February when a Jane Doe whose 2013 rape claims against the producer contributed to his L.A. criminal conviction dropped her civil case. Just weeks before the matter was to go to trial on March 24, Doe's lawyers asked L.A. Superior Court Judge Elaine W. Mandel on February 4 to dismiss the sexual battery, false imprisonment, negligence and intentional infliction of emotional distress case without prejudice. Delhi man facing rape charges
DELHI, N.Y. (WIVT/WBGH) – A Delhi man is being accused of raping another person. Delaware County District Attorney Shawn Smith announced the unsealing of a five-count indictment against 34-year-old John Pierre Regazzi. Count One accuses Regazzi of Rape in the First Degree, a Class B Felony. It is alleged that Regazzi, on August 1, 2024, had sex with another person without their consent and by forcible compulsion. Count Two alleges Criminal Sexual Act in the First Degree, a Class B Felony. Regazzi, on August 1, 2024, allegedly engaged in oral sexual conduct with another person without their consent and by forcible compulsion. Count Three accuses Regazzi of Assault in the Third Degree, a Class A Misdemeanor. It is alleged that Regazzi, on August 1, 2024, with the intent to cause physical injury to another person did cause injury to another person. Count Four alleges Menacing in the Second Degree, a Class A Misdemeanor. It is alleged that Regazzi on August 1, 2024, intentionally placed another individual in reasonable fear of physical injury, serious physical injury, or death, by displaying a dangerous instrument. Count Five accuses Regazzi of Unlawful Imprisonment in the Second Degree, a Class A Misdemeanor. Regazzi allegedly restrained another person. The office says due to its policy, the victim is not being named at this time. Harvey Weinstein Insists He'll Die At Rikers If NYC Rape Trial Isn't Moved Up
A gaunt-looking Harvey Weinstein pleaded with the judge in his upcoming criminal retrial to move the start date forward, even by a week, because 'I don't know how much longer I can hold on' while the fallen mogul remains imprisoned in New York City's notorious Rikers Island jail. Judge Curtis Farber on Wednesday morning set April 15 as a trial date after denying a motion by Weinstein to the indictment against him dismissed. With the schedule set, the cancer-stricken Weinstein, seated in a wheelchair, addressed the judge directly. 'Every week counts. I'm holding on because I want justice for myself. I want this to be over.' He said that 'every day is a struggle' at Rikers, which he referred to as a 'hellhole' and a 'stain on this city.' He described his surroundings as 'medieval' and said he anticipates being sent back to Manhattan's Bellevue Hospital 'any day' because his health is so poor. Farber said he would consider an April 7 trial date if all lawyers agree. 'Judge Farber demonstrated exceptional responsiveness, and we deeply appreciate his thoughtful consideration of Harvey's condition and circumstances,' Weinstein's attorneys said in a statement. 'We remain confident in a swift and efficient trial process and firmly believe that Harvey will be fully exonerated. Weinstein was one of Hollywood's most influential and visible studio bosses until an era of reckoning ushered in by the #MeToo movement led to his eventual downfall. Multiple women came forward to say that the former Miramax chief had used his power and position to coerce them into sexual encounters. Several of those allegations became the basis of criminal indictments against Weinstein in New York and Los Angeles. He first was arrested in New York in May 2018, in a remarkable spectacle of a powerful media executive being led away in handcuffs. The New York Court of Appeals overturned his 2020 felony sex crimes conviction by a vote of 4-3 in April, ruling that the original trial judge, James Burke, should have barred testimony from women whose sexual assault allegations against the Oscar-winning Shakespeare in Love and Pulp Fiction producer were not part of the original 2018 indictment. The appeals court ordered a retrial, and the Manhattan District Attorney's office added 'one count of Criminal Sexual Act in the First Degree and Rape in the Third Degree involving two other complaining witnesses for assaults that occurred in July 2006 and March 2013, respectively,' prosecutors wrote in a memo this month opposing Weinstein's latest motions to dismiss the revised indictment. Weinstein remains behind bars as he awaits the new trial. His felony sex crimes conviction in Los Angeles still stands, and his health since the revelation in October that he had cancer remains an open question. Dominic Patten contributed to this report.
