Abu Dhabi court acquits man in Dhs44,000 case after decisive oath

Abu Dhabi Family and Civil and Administrative Cases Court has dismissed a lawsuit filed by a man against another, demanding payment of Dhs44,900. The appellee had allegedly purchased sports equipment from the plaintiff at a public auction and agreed to pay the amount after receiving the equipment. However, after receiving it, the appellee paid only Dhs20,000 in cash and Dhs10,000 through a bank transfer. When the plaintiff demanded the remaining payment, the appellee refused. The court directed a decisive oath to the appellee who confirmed that he had paid the full amount for the sports equipment. The plaintiff demanded that the appellee be ordered to pay him Dhs44,900 the remaining amount of the price agreed upon and compensation for material and moral damages, besides a legal interest of 12% from the date of filing the lawsuit until full payment, along with legal fees, expenses, and attorney's fees. The appellee acknowledged purchasing sports equipment from the plaintiff for Dhs74,900, which was shipped to his gym and gave the plaintiff Dhs20,000 in cash and after a month, he transferred to him Dhs10,000, and later paid Dhs45,000 in cash in the presence of witnesses. The judge heard the first witness after administering the legal oath. The witness, a trainer at the appellee's gym, testified that he saw the appellee hand over Dhs45,000 to the plaintiff for the sports equipment purchased from him. The judge then heard the second witness after administering the legal oath. The witness stated that he was present when the appellee handed over the remaining Dhs44,900 to the plaintiff for the sports equipment purchased from him. The court directed a supplementary oath to the appellee to swear that he had paid the plaintiff Dhs74,900 for the sports equipment purchased from him. The appellee confirmed that he had no further debts, and based on this, the court acquitted him of the plaintiff's claims.
