Oneonta man accused of shooting train on Norfolk Southern Railway
TOWN OF ONEONTA, N.Y. (WIVT/WBGH) – An Oneonta man is facing felony charges after allegedly opening fire on the Norfolk Southern Railway on Wednesday.
The Otsego County Sheriff's Office announced the arrest of 33-year-old James Fulginiti following a shots fired complaint in the Town of Oneonta.
On Wednesday, at approximately 5:08 p.m., Deputies were dispatched to the area of the railway just off of State Highway 7 and Corporate Drive. Otsego County 911 Dispatchers received reports of a male walking down the railway and allegedly shooting a firearm at a train.
Responding officers located the suspect, later identified as Fulginiti, and took him into custody.
During an investigation, it was determined that Fulginiti had allegedly fired a BB gun at the train conductor compartment and struck the windshield. The train conductor was not injured during the incident. However, the train windshield was damaged.
Fulginiti was taken to the Otsego County Sheriff's Office for processing and was charged with the following:
Unlawful Interference with Railroad/Train
Unlawful Propulsion of a Missile at Railroad Trains
Criminal Mischief Third Degree
Criminal Possession of a Weapon Third Degree
Criminal Possession of a Weapon Fourth Degree
Menacing in the Second Degree
Criminal Trespass in the Third Degree
Fulginiti was turned over to the Otsego County Corrections to be held for Centralized Arraignment.
The Otsego County Sheriff's Office was assisted by the New York State Police and Norfolk Southern Railway Police.
