Kota Kinabalu: A 32-year-old who assaulted his 67-year-old father last week, was sentenced to five months' jail on Wednesday. Gnana Sivan Rijkaard A/L Gnanasekaran pleaded guilty before Magistrate Dzul Elmy Yunus to voluntarily causing hurt to Gnanasekaran A/L S. Thuraisingam on May 18, this year, at 3.30am, at a house in Taman Kasigui, Penampang. The court was informed by the prosecution that Gnana became upset with the victim's response when he asked about his mother's whereabouts. Without warning, Gnana punched the victim in the left eye, causing swelling and bruising. The prosecution said police arrested Gnana later that same day at 3.30pm, after the victim lodged a report about the incident. The court ordered Gnana to serve the sentence from the date of his arrest. Advertisement Gnana was charged under Section 324 of the Penal Code read with Section 326A of the same Code. The charge carries a jail term of up to 10 years or a fine, or whipping, or with any two of such punishment on conviction while Section 326A states that whoever causes hurt to his spouse or former spouse, a child, a disabled adult, or other family members and commits an offence under Section 323, 324, 325, 326, 334 or 335 shall be punished with imprisonment for a term of twice as long as the maximum term for which he would be liable to conviction for that offence. In another case, a van driver was charged with disposing of stolen property. Wong Chee Sheng, 31, is accused of committing the offence on one unit of wheel rim belonging to Alfred Michael on May 20, this year, at 4.40pm, at a premises in Mile 7, Jalan Tuaran. Wong claimed trial to the charge under Section 414 of the Penal Code. The court fixed July 17 for pre-trial case management and released the accused on a bail of RM1,800 in two sureties. Earlier, the prosecution proposed bail at RM4,000 in two sureties. Counsel Jagnesh Jaya representing Wong, requested a lower bail amount. Meanwhile, four men were penalised for having syabu. Zeno Justin, Nelson Robas, Binsal Najal and Saeman Amjalun pleaded guilty to having syabu weighing 3.72gm, 0.10gm, 0.07gm and 0.06gm, respectively at separate locations here and in Penampang in April. Zeno was fined RM3,500 or 10 months jail, Nelson was fined RM1,800 or six months jail while Binsan and Saeman were jailed seven months and six months respectively. They were each charged under Section 12 (2) of the Dangerous Drug Act (DDA), which provides for a fine of up to RM100,000 or up to five years or jail or both ,on conviction. Binsal and Saeman were also jailed five months each for another offence of taking syabu under Section 15(1) of the DDA, which provides for a fine of up to RM5,000 or up to two years in jail, on conviction.
