Bombay HC orders raids in Gopal Snacks' trademark case

Rajkot: A multi-city trademark and copyright infringement raid was carried out in Surat and Mumbai on Tuesday after Rajkot-based Gopal Snacks Ltd secured an ex-parte order from the Bombay high court, alleging infringement of its registered trademark. The company filed a petition in the Bombay HC contending that entities operating under the names 'Gopendra', 'Shree Gopal' and 'Gops' were using deceptively similar packaging and unlawfully exploiting the 'Gopal' trademark. The Bombay high court appointed a court commissioner in Mumbai and an additional special court receiver in Gujarat, authorizing them to conduct raids with police assistance. On a single day, the authorities executed raids at five locations — four in Surat (targeting Gopendra, Shree Gopal and Gops) and one in Mumbai — resulting in the seizure of significant quantities of counterfeit goods and packaging materials, according to a statement from D N Ahya and Company, an intellectual property and corporate law advisory firm. Darshit Ahya, a company secretary and advocate, said, "These infringing goods were available in Mumbai and since Gopal Snacks has its principal place of business in Mumbai along with a manufacturing plant in Maharashtra, we filed the suit in the Bombay high court. We requested an ex-parte order to prevent the defendants from intentionally concealing or disposing of the infringing goods before the search." Ahya added that a report on the raids will be submitted to the court in seven days.
