20 illegals are jailed for entering Sabah without any identification documents

Kota Kinabalu: Twenty illegal immigrants were jailed four months each for entering the State without any identification documents. They were Zulbare Makmun, Tikong Akmad, Siti Rahmah Sarabun, Saliha Mahmon, Norisah Tikung, Kimar Abdu, Kamal Amijun, Julmin Tula, Fajar Akino, Haris Malaira Ahamad, Bella Julmin, Barandino Najirar, Arman Enang, Najir Umra, Hasan Hamjah, Roslan Nasirin , Umra Hajar, Arkam Imran @ Akram, Munir Umra and Yusof Jahin @ Yussof Jahin. The illegal immigrants, aged between 24 and 50, pleaded guilty separately before Sessions Court Judge Hurman Hussain, to the charges against them. They were arrested in the different places such as Sulaman and city areas, respectively, for entering the State without any identification documents. They were detained after failing to produce their identity documents during operations carried out by the Immigration personnel at the said areas. They were charged under Section 6(1)(c) of the Immigration Act 1959/63 which provides for a jail term of up to five years, or a fine of up to RM10,000, on conviction. In mitigation, they pleaded for leniency and asked to be deported to their homeland as soon as possible. The court ordered the illegal foreigners to serve the jail sentence from the date of their arrests. In the same court, a Pakistani and an Indonesian were jailed and fined for staying in the State after their documents had been expired. Imtaz Khan was ordered to pay RM10,000 or six months' jail for overstaying for eight months and five days after his Special Pass had expired on July 12, 2024 and he was arrested on March 17, this year, at the Kedai Mashal Khan Enterprise in Kg Luagan, Beaufort. Meanwhile, Jumardi was jailed 12 months for overstaying three years and three months after his Student Pass expired on Dec 31, 2021 and was detained on Apr 17 this year at a house in Jalan Sulaman, Tuaran. Woman who overstayed 22 years to ‘stay on' a year

Kota Kinabalu: An Indonesian woman who had overstayed in Sabah for 22 years and seven months, was ordered to stay in prison for a year. Rovina Bulu Sanga pleaded guilty before Sessions Court Judge Hurman Hussain, to the charge against her. She was detained on Apr 15 this year at 10.15am in Keningau after she produced her Social Visit Pass which had expired on Sept 15, 2002. The offence under Section 15(1)(c) of the Immigration Act carries a jail term of up to five years, or a minimum fine of RM12,000, or both, on conviction. The court ordered Rovina to serve the jail sentence from the date of her arrest and referred to the Immigration Department for further action after completing the sentence. In the same court, a 32-year-old woman was fined RM5,000 or spend three months in prison for allowing an illegal immigrant to stay in the premises under her control. Nur Shafira Adilya Mathius Abdullah pleaded guilty before Sessions Court Judge Hurman Hussain, to permitting a 61-year-old Indonesian woman to stay in the Tawau Delight Restoran in Sipitang. The charge stated that the Indonesian did not have any identity document and Nur Shafirah was found committing the offence at 10.10am on Nov 19, 2024. Meanwhile, eight illegal immigrants were jailed four months each for entering the State without document. They were Dayang Mohammad, Surianti Sendo, Rudianto Arshad, Jimbar Ammook, Kendong Sagun, Adzmjn Aminusin, Jufri Dadda and Muh Tahir. All of them admitted to entering the State illegally and were arrested in Keningau recently during an operation conducted by the Immigration Department. The eight failed to produce their identity documents to the immigration personnel. Prosecuting Officer Norizan Awang Tanda prosecuted. Sexual act on girl, 9: Man given discharged and acquitted

Kota Kinabalu: A 34-year-old man was discharged and acquitted (DNA) from two charges of committing physical sexual harassment against his niece. Sessions Court Judge Hurman Hussain freed the man on Monday, after being informed by the prosecution that the alleged victim and her father did not wish to continue with the case. Earlier, the prosecution told the court that the prosecution decided to discontinue the case and asked for a discharge not amounting to an acquittal to be given to the man whose case was brought for mention to know the status of the outcome of the representation letter. However, counsel Mohamad Syazwan Shah Mohamad Ali who defended the man, requested for DNA to be given to his client since the alleged victim and her father were not interested to proceed with the case. On the first count, the man was accused of committing the offence by asking the nine-year-old girl to perform oral sex on him at 10pm in June 2023 at a house in Kg Marakau, Ranau. On the second count, he allegedly committed the offence by asking the same girl to hold his private parts at the same place and time. On May 27, 2024, the man was charged under Section 14(a) of the Sexual Offences Against Children Act 2017 which provides for a jail term of up to 20 years and whipping, on conviction. The court ordered for the bail sum that posted by the man previously, to be refunded to him. Meanwhile, two women and six men were jailed four months each for entering the State without identity documents. The eight admitted to the charge against them and were arrested recently at the city area by the police after failing to produce their identification documents. Man acquitted of sexual harassment charges after case dropped
KOTA KINABALU (April 21): The Sessions Court has discharged and acquitted a 34-year-old man who was accused of sexually harassing his nine-year-old niece after the alleged victim and her father decided not to pursue the case. Judge Hurman Hussain granted the discharge and acquittal (DNA) following a request by the accused's lawyer, Mohammad Syazwan, as the family no longer wished to proceed. The man had faced two charges under Section 14(a) of the Sexual Offences Against Children Act 2017, which carries a maximum penalty of 20 years' jail and whipping. The alleged offences were said to have occurred in June 2023 at a house in Kampung Marakau, Ranau. The court also ordered the refund of the bail amount paid by the accused. Meanwhile, the High Court will determine on May 23 whether Sangdesar Bunjing, 37, will be required to enter his defence or be acquitted of a drug trafficking charge under Section 39B(1)(a) of the Dangerous Drugs Act 1952. High Court judge Datuk Dr Lim Hock Leng fixed the date after the prosecution closed its case, having called five witnesses, including a chemist. Sangdesar had pleaded not guilty to trafficking 339.1 grammes of syabu on February 12, 2024, around 12.45 am, in a Perodua Kancil car parked at the Pos Aviation warehouse parking lot near here. If convicted, he faces the mandatory death penalty or life imprisonment, along with no fewer than 15 strokes of the cane. Deputy public prosecutor Dacia Jane Romanus appeared for the prosecution, while assigned counsel Jamadi Saleh represented the accused.
