ATLANTA (AP) — A jury has awarded a Georgia couple $2.25 million in their lawsuit accusing a pathologist of posting graphic videos of an autopsy of their decapitated baby. A Fulton County jury returned the verdict against Dr. Jackson Gates on Wednesday. The couple, Jessica Ross and Treveon Isaiah Taylor Sr., hired Gates to perform an autopsy on their son, Treveon Taylor Jr., who was decapitated during delivery in July 2023. They have separately sued the doctor who delivered the baby and the hospital where the delivery occurred. That case is pending. In a lawsuit filed in September 2023, the couple said Gates posted several videos of the autopsy on Instagram without their permission. Gates initially removed the videos after receiving a letter from the couple's attorneys, but then reposted them, according to the couple's attorneys. Ira Livnat, an attorney for Gates, said Saturday the jury's finding that Gates did not intend to cause harm 'flies in the face' of the plaintiffs' 'entire case.' His client generally made posts about autopsies to educate other pathologists and advocate for independent evaluations when people felt a hospital had engaged in wrongdoing, he said. The couple received a default judgment for intentional infliction of emotional distress, invasion of privacy and fraud after Gates did not immediately respond to their lawsuit. 'Dr. Gates testified that he is deeply sorry for any harm that he unintentionally caused the plaintiffs,' Livnat said. 'Had he known for one second that they would see that and that they would know it was their child, he would never have done it.' Attorneys for the couple said in a statement that the doctor 'poured salt into the couple's already deep wounds.' 'This young couple trusted him with the remains of their precious baby,' they said. "Graphic and grisly" footage from the baby's post-mortem was shared on Instagram. The parents of a baby who was tragically decapitated during childbirth have been awarded millions after a pathologist shared graphic footage of their son's post-mortem examination online. Jessica Ross and Treveon Taylor Sr. were unable to see their first child - whom they called Treveon Isaiah Taylor Jr. - following his birth on July 10, 2023. He had become stuck behind her pelvic bone after several hours of labour. ‌ Medics did not tell the couple his head had been severed during the delivery, according to court documents. They later hired pathologist Dr Jackson Gates, after a funeral home informed them of the condition of their son's body. ‌ However, he shared a video of the baby's body on social media, showing "graphic and grisly detail of post-mortem examination" and his "decapitated, severed head", according to lawyers for the parents. Although he deleted the video from Instagram, he posted a further two just a few days later, all of which the couple said were shared without their permission, the Mirror reports. Cory Lynch, a lawyer for the couple told Fox 5 Atlanta: "For him to post these images and videos without permission was insane to us. "And especially with the nature of the posts... of the grisly details of the autopsy examination and also pictures of the child's head. It was baffling that he would do something like that." In September 2023, Ms Ross and Mr Taylor took legal action against Gates and the firm Gates Rapid Diagnostic Laboratory of Atlanta. The doctor did not respond, leaving the State Court in Fulton County, Georgia, to decide the case. ‌ The pathologist's lawyer Ira Livnat, who was hired after the court's decision, claimed this resulted in the case ending in favour of the parents, stating: "The plaintiffs got the absolute best case." A lawyer for Gates said the doctor "deeply, deeply regrets any harm" but in a social media post that has since been removed, he called the outcome "a complete miscarriage of justice" declaring that he intended to appeal the decision. Gates said he still shares post-mortems online, according to Atlanta News First.

An Atlanta doctor and his clinic must pay US$2.25 million to a couple after posting to his public social media account graphic videos of their decapitated baby during an autopsy, a jury has decided. Advertisement Jackson Gates and his business, Medical Diagnostic Choices, were found liable by default in the lawsuit brought against them by Jessica Ross and Treveon Taylor after the couple discovered the social media posts. Ross and Taylor said they were horrified and outraged when they learned Gates had published without their knowledge or permission images of their child, who was decapitated during a difficult delivery July 9, 2023. The couple had hired Gates to perform an autopsy. On Wednesday, an Atlanta jury awarded the couple US$2 million in compensation and US$250,000 in damages designed to punish Gates and Medical Diagnostic Choices. The jurors found Gates did not intend to cause harm. 'They asked for US$30 million and they got just over US$2 million,' said Gates' lawyer, Ira Livnat. 'Obviously we were disappointed with the verdict, but the jurors' finding that he did not act with specific intent to cause harm was very significant.' Advertisement Lawyers for Ross and Taylor said they are pleased the jury punished Gates for his 'reprehensible' behaviour, though nothing can ease the couple's pain over their son's 'horrific' death.
