TAMPA, Fla., (WFLA) – All five teenagers accused of brutally beating another teenager will appear back in court Wednesday morning. The judge is expected to rule on whether the five teens who are being tried as adults, will receive bond or stay in jail until trial. The incident happened at a Davis Island dog park on February 13. This past Saturday, a judge ruled probable cause for the attempted murder charges for four of the teens. Ely was not present in court over the weekend. 'Mr. Ely you're charged with attempted murder in the first-degree aggravated battery with a deadly weapon, throwing a deadly missile at within or into a vehicle, aggravated assault with a deadly weapon, and burglary of a conveyance with assault or battery,' said the judge. Ely's attorney disputed the claim. 'We definitely challenge the probable cause for count one. I think the evidence that the state is referring to in their motion is not does not bear out from the evidence that was presented at the hearing,' said the attorney. The other teenagers accused of being involved are Owen Callahan, Joseph Gesaule, Jace Villanueva, and Grayson Shearer. 18-year-old Orian Robertson has also been charged with felony battery and burglary. On Saturday, one of the teenager's attorneys tried to argue that before this incident, his client has never been in trouble. On the other hand, prosecutors said the victim could have been killed during the attack. 'He's done everything in his life, prior to this incident, the right way,' said an attorney. 'They drag him away from the car, the defendant asked the other defendants to clear a path so that he can then commit the next action, which is to throw a heavy rock at the victim's head while he was unconscious. What we know All five teens who were arrested have been identified as 17-year-old Owen Callahan, 17-year-old Jacob Ely, 16-year-old Joseph Gesuale, 16-year-old Jace Villanueva and 15-year-old Grayson Shearer. The Hillsborough State Attorney's Office also said an 18-year-old, Orian Robinson, was also arrested in the brutal attack. According to detectives, the night began with everyone involved in the incident gathering for a bonfire at Davis Islands. The cell phone video, confirmed by the Tampa Police Department to be part of their investigation, shows the chaos that ended the night. A group of teenagers, which includes one person holding a knife, could be seen surrounding a black pickup truck with a teenage driver and passenger. Police said another teenager threw a rock, which can be heard hitting the vehicle. The victim was pulled from the truck and beaten until he was unconscious. Police arrested six of the suspected attackers, and all were charged with battery or assault and a 17-year-old faced an attempted murder charge. Dig deeper However, the Hillsborough State Attorney's Office said most of the teens are facing upgraded charges with the news that each of the suspects will be charged as adults. Prosecutors said Thursday night in a press release, "Our prosecutors have reviewed the facts and evidence, including several videos of the incident, which are difficult to watch." TAMPA, Fla. (WFLA) — Five minors who were arrested after assaulting another teenager at the Davis Island Dog Park earlier this month have been charged as adults, according to prosecutors. On Feb. 13. the five suspects approached a pickup truck where the victim was sitting. The individuals involved and their charges are as follows: Owen Callahan, 17, charged with attempted murder in the first degree Jacob Ely, 17, charged with attempted murder in the first degree, aggravated assault with a deadly weapon, aggravated battery with a deadly weapon, and throwing a deadly missile at or into a vehicle.
