A single judge ruled in their favor, allowing the property to be attached. Actor Prabhu, however, filed a fresh petition asserting that Annai Illam was registered in his name and that his brother Ramkumar had no ownership rights. He urged the court to cancel the order. CHENNAI: The Madras High Court has lifted its order to attach parts of the late actor Sivaji Ganesan's bungalow in a loan default case involving his son Ramkumar Ganesan and grandson Dusshyanth Ramkumar. Justice Abdul Quddhose passed the order on Monday while allowing an application filed by Ramkumar's brother and actor Prabhu Ganesan, who claimed full ownership of the property. The court, on February 10, issued the order based on an execution petition filed by Dhanabakkiam Enterprises. The firm had lent Rs 3.74 crore in 2017 to Dusshyanth's company, Eshan Productions, to finance the movie 'Jagajala Killadi'. As the loan was not repaid, the firm approached the court and an arbitrator was appointed. On May 5, 2024, the arbitrator directed payment of Rs 9.02 crore, including interest. The order was not complied with, prompting Dhanabakkiam Enterprises to seek attachment of properties for recovery of Rs 9.39 crore. However, Prabhu approached the court stating that he is the sole owner of the bungalow and that Ramkumar has no share in the property. He submitted documents to support his claim. Following this, the court directed Ramkumar to file an affidavit, in which he confirmed he holds no stake in the bungalow. Going through the documents submitted, Justice Quddhose said, 'For the foregoing reasons, it is clear the applicant (actor Prabhu) is undoubtedly the absolute owner of the attached property and the respondents/judgment debtors do not have any right, title or interest in it.'

Chennai: Madras high court on Monday recalled its order attaching house of the late actor Sivaji Ganesan in a case relating to default on a loan by his son, Ram Kumar, and grandson, Dusshyanth. Justice Abdul Quddhose recalled the order while allowing a plea moved by actor Prabhu claiming that his brother doesn't have any stake in their father's T Nagar house, ' Annai Illam '. On March 3, the court passed the attachment order on a plea moved by Dhanabakkiam Enterprises to execute a decree in its favour. According to Dhanabakkiam Enterprises, a loan of 3.75 crore was issued to Eshan Productions, represented by Dusshyant and his wife for producing a film 'Jagajala Killadi'. As Dusshyant failed to repay the loan, arbitration proceedings were initiated . A decree was issued in favour of Dhanabakkiam Enterprises to exploit all rights in connection with the film. Since the film could not be completed, the arbitral decree could not be executed by Dhanabakkiam Enterprises, prompting it to move an execution petition to attach Sivaji's house, in which Dusshyant's father, Ram Kumar, holds a share. It wanted the court to execute the arbitral award dated May 4, 2024. During the course of the hearing, the court was informed that Ram Kumar does not hold any stake in the house, and it wholly belongs to Prabhu.

However, when the company failed to return the loan, Dhanabhakyam Enterprises took the matter to court, where retired Justice Ravindran was appointed as mediator. Mediator orders film rights transfer to recover dues. According to Nakkheeran, the mediator ruled that all rights related to Jagajala Killadi should be transferred to Dhanabhakyam Enterprises to recover the dues, which amounted to Rs 9.39 crore, including interest. He also instructed that any balance amount beyond the loan recovery should be handed back to Eshan Productions. However, when the production house was asked to hand over the rights, they refused, claiming the film was still incomplete. This refusal led Dhanabhakyam Enterprises to escalate the matter further through legal channels. Seizure order issued on Annai Illam sparks family conflict. In a dramatic turn, Dhanabhakyam Enterprises filed a case at the High Court seeking the attachment of Annai Illam, the iconic residence of Ganesan, to enforce the court's previous order. The court initially approved the seizure, but actor filed a counter-petition, asserting that the property was legally registered under his name and that his brother, (Dushyanth's father), had no ownership claim. Court recognizes Prabhu as sole owner of Sivaji Ganesan's Annai Illam. Following this, the court instructed Ramkumar to submit an affidavit stating he had no rights over Annai Illam now or in the future. Based on this evidence, the court cancelled the seizure order and directed the land records department to remove the attachment record, officially recognizing Prabhu as the legal owner.
