KUALA LUMPUR: Former prime minister Tan Sri Muhyiddin Yassin has submitted a letter of representation to the Attorney General's Chambers (AGC) seeking to drop his seven charges linked to the Jana Wibawa scandal. Deputy Public Prosecutor Lead Datuk Wan Shaharuddin Wan Ladin told the High Court that the AGC had received the letter last week. He said the representation is currently being studied. The matter was brought up during a mention before High Court judge Justice K. Muniandy here on Tuesday (Aug 5). The court fixed Oct 7 for the next mention date. Lawyer Datuk Amer Hamzah Arshad appeared for Muhyiddin during the proceedings. Muhyiddin, 77, was charged with four counts of using his position to obtain bribes totalling RM232.5mil in connection with the Jana Wibawa Project from Bukhary Equity Sdn Bhd, Nepturis Sdn Bhd, Mamfor Sdn Bhd, and Datuk Azman Yusoff for Bersatu. He allegedly committed the offence at the Prime Minister's Office in Putrajaya between March 1, 2020, and August 20, 2021. Muhyiddin also faces three charges of receiving RM200mil from illegal activities, deposited into Bersatu's AmBank and CIMB Bank accounts. The offences were allegedly committed at AmBank, Amcorp Mall branch, Petaling Jaya on January 7, 2022, and at CIMB Bank, Menara KL Branch, Jalan Stesen Sentral between February 25 and July 16, 2021, and February 8 and July 8, 2022.

KUALA LUMPUR: Former Prime Minister Tan Sri Muhyiddin Yassin has submitted a letter of representation to the Attorney-General's Chambers (AGC) seeking the withdrawal of seven charges against him involving abuse of power and receiving funds from unlawful activities. Deputy Public Prosecutor Datuk Wan Shaharuddin Wan Ladin informed High Court Judge K. Muniandy of the development during case mention proceedings today. He said the representation was filed at the end of last month and is currently under consideration by the AGC. This is the first representation submitted in relation to the case. Muhyiddin was present in court, accompanied by his lawyers Datuk Amer Hamzah Arshad and Rosli Dahlan. The court has fixed Oct 7 for the next mention. Muhyiddin, 78, who was then Prime Minister and Bersatu president, was charged with four counts of abuse of power for allegedly soliciting RM232.5 million in bribes for the political party from Bukhary Equity Sdn Bhd, Nepturis Sdn Bhd, Mamfor Sdn Bhd, and Datuk Azman Yusoff in connection with the Jana Wibawa project. He was accused of committing the offence at the Prime Minister's Office, Bangunan Perdana Putra, Federal Government Administration Centre in Putrajaya between March 1, 2020, and Aug 20, 2021. The Pagoh Member of Parliament also faces three charges of receiving RM200 million in illegal proceeds from Bukhary Equity Sdn Bhd, which were deposited into Bersatu's Ambank and CIMB Bank accounts. Lead prosecutor Datuk Wan Shaharuddin Wan Ladin told the High Court today that the Attorney-General's Chambers received the letter last week and is now considering the matter. He was speaking before High Court judge K. Muniandy during the hearing. The court has fixed Oct 7 for the next hearing. Muhyiddin was represented by lawyers Datuk Amer Hamzah Arshad and Rosli Dahlan. Muhyiddin Yassin is accused of abusing his power as prime minister by seeking to obtain RM232 million in 2021 for his party, Bersatu. KUALA LUMPUR : Former prime minister Muhyiddin Yassin's abuse of power and money laundering case in relation to the Jana Wibawa programme has been transferred to the High Court. Justice Jamil Hussin ruled that three legal issues were likely to arise in the course of the trial which the High Court should address. 'The three legal issues that will arise are extraordinary legal issues. 'Although I have full confidence that the sessions court judge has the legal knowledge and expertise to handle this case, it is more expedient for the three legal issues to be determined by the High Court,' he said. The first issue revolves around whether the trial judge can rely on both legal presumptions against an accused under Sections 23(2) and 50(1) of the Malaysian Anti-Corruption Commission (MACC) Act 2009 if the prosecutors can establish the underlying facts. The second issue is whether, in law, the monies allegedly received by Bersatu constituted legitimate political donations or unacceptable gratification. The third legal issue is whether the term 'organisation' as defined in the MACC Act can be construed to include a political party. Jamil said Muhyiddin had met the threshold set by Section 417 of the Criminal Procedure Code to allow a transfer from the sessions to the High Court. The judge then told parties that the court registrar would determine which High Court judge would preside over the trial. The court fixed July 14 for case management. MACC legal and prosecution division head Wan Shaharuddin Wan Ladin appeared for the prosecution, while senior lawyer Hisyam Teh Poh Teik represented the Bersatu president. Muhyiddin, 78, was charged in the sessions court with abusing his power as prime minister in connection with the Jana Wibawa programme by seeking to obtain RM232 million for his party, Bersatu, in 2021. He was also charged with two counts of receiving money from illegal activities, amounting to RM195 million from Bukhary Equity, which was deposited in Bersatu's CIMB Bank account. He was also charged in the Shah Alam sessions court in March 2023 with receiving money from illegal activities amounting to RM5 million. The case was later transferred to the sessions court here for a joint trial.

Judge Azura Alwi granted the former prime minister's application following a request from his lawyer Kee Wei Lon, which was not objected to by DPP Noralis Mat. The judge said the passport, which was to be handed over to the applicant yesterday, must be returned to the court on May 20, Bernama reported. The court had granted Muhyiddin's application for the temporary release of his passport several times previously, including to attend his grandchild's graduation ceremony and ­medical consultation in London, medical check-up in Singapore and opening of his friend's restaurant in Thailand. Muhyiddin, 77, in his capacity as then-prime minister and Bersatu president in 2020, is accused of abusing his position to solicit RM232.5mil in bribes rela­ted to the Jana Wibawa project from Bukhary Equity Sdn Bhd, Nepturis Sdn Bhd and Mamfor Sdn Bhd, as well as from Datuk Azman Yusoff, for the benefit of his political party. The four abuse of power offences were allegedly committed at the Prime Minister's Office between March 1, 2020 and Aug 20, 2021. He is also facing two counts of receiving proceeds from unlawful activities amounting to RM195mil from Bukhary Equity that was deposited into Bersatu's CIMB account at the Menara KL branch, between Feb 25 and July 16, 2021 and Feb 8 and July 8, 2022. Muhyiddin was also charged in the Sessions Court in Shah Alam on March 13, 2023, with receiving money from illegal activities amounting to RM5mil.
