HC upholds amendments by govt in rules prior to appointments

Ranchi: The Jharkhand high court has held that appointed candidates cannot claim for changes made by the authority prior to appointments. The Jharkhand Staff Selection Commission (JSSC) had issued an advertisement for appointment of compounders and pharmacist in the scale of Rs 5,200 to 20,200 and at a grade pay of Rs 2,800. The eligibility criteria for appointment of compounders and pharmacists was kept similar. However, the state govt made an amendment in the rules prior to the appointment and reduced the grade pay for compounders from Rs 2,800 to Rs 1,900. Santosh Kumar and several other candidates, who had been appointed as compounders, challenged the amendment before the high court. Kumar, in his petition, said that the grade pay for compounders should not have been reduced by the govt as the eligibility criteria for compounders and pharmacists were the same. The govt, on the other hand, argued before the court that the amendment was made prior to the appointments. The candidates were aware of the amendment and have accepted their appointment. Challenging the amendment after the appointment by the candidates cannot be allowed at this stage, the govt contented before the high court. A division bench of Justices Sujit Narayan Prasad and Pradeep Kumar Srivastava passed their order upholding the decision of the govt.

Ranchi: The state govt on Wednesday informed the Jharkhand high court that investigation into the alleged leak of question papers of the Jharkhand Staff Selection Commission Combined Graduate Level (JSSC CGL) exam would be completed within a month's time. Tired of too many ads? go ad free now Advocate general Rajiv Ranjan informed the court that the case was being probed by the CID. A chargesheet has been filed against three persons. Investigation done till now has not revealed that question paper was leaked, he added. A division bench of Chief Justice MS Ramachandra Rao and Justice Rajesh Shankar were hearing a public interest litigation (PIL) filed for an independent probe into the alleged leak of question papers of the JSSCCGL exams. Earlier, the court had clamped a stay on the release of results of the exams and directed the govt to initiate investigation through the police. The stay on the publication of results will continue. The JSSCCGL examinations were conducted by the conducted by the Jharkhand Staff Selection Commission (JSSC) on January 28, 2024. There were allegations of leak of question paper due to which the examination was cancelled. The exams were again conducted on September 21 and September 22 last year. It was again alleged that the papers were leaked. The examinations were conducted to fill 2025 vacant posts across different departments in the state govt. The case would next be heard on June 18.
