Bengaluru stampede: Retired HC judge to head probe, fix responsibility
The one-man inquiry commission constituted by the Karnataka government under retired High Court judge John Michael Cunha to inquire into the June 4 stampede that killed 11 people, has been asked to identify the persons responsible for the omissions or deficiencies that led to this incident. As per the terms of reference to the commission from the government, it has also suggested precautionary measures that can be taken to prevent recurrence of such incidents in the future, among others. Chief Minister Siddaramaiah on June 5 announced that a one-man commission would be formed under Cunha to look into the procedural lapses in the issue, and the commission has been asked to give the report in 30 days. The stampede occurred on June 4 evening in front of the Chinnaswamy stadium here, where a large number of people thronged to participate in the RCB team's IPL victory celebrations. Eleven people died and 56 were injured in the incident. "...the Government, in exercise of the powers conferred under sub-rule (1) of rule 3 of the Commission of Inquiry Act, 1952, has constituted a one-man inquiry commission under the chairmanship of John Michael Cunha, retired Judge of the Karnataka High Court, to conduct an inquiry into the incident," the official notification dated June 5 said. "The inquiry commission shall have all the powers to conduct inquiries under the provisions of the Commissions of Inquiry Act, 1952 and Code of Civil Procedure, and the government expects the investigation to be completed and a report submitted within one month," it said. The terms of reference in the notification include, to find -- whether the necessary permissions, rules and procedures were followed while organising the RCB team's victory felicitation ceremony at Chinnaswamy Stadium; the causes/causers of the rush and stampede that took place; the causes/causers of the incident that led to the death of 11 people and injury to more than 50 people based on the chain of events and circumstances. Also, to inquire into the measures taken as a precaution regarding the incident and the omissions/deficiencies that may have occurred in this regard and to identify those responsible for this incident; and to inquire regarding other relevant aspects related to this incident. As per the notification, the Director General and Inspector General of Police, Commissioner of Police - Bengaluru, and Deputy Commissioner - Bengaluru Urban district shall provide all the files/documents/etc that the Commission may require from time to time for the inquiry and shall be present during the inquiry and fully cooperate with the Commission. This inquiry commission is separate from the magisterial inquiry that has been ordered, and shall conduct a parallel and comprehensive inquiry, it clarified. The Chairman of the inquiry commission, if necessary, may take steps to obtain the services of one retired IPS officer and one retired IAS officer for technical and legal assistance. The salary/allowance expenses of the concerned officers shall be borne by the government. The Director General and Inspector General of Police, shall provide the necessary staff, materials, vehicles and office and furniture/telephone etc required for the commission of inquiry.

KSCA president Raghuram Bhat said the resignations were accepted during an emergency managing committee meeting. "We are ready to cooperate fully with the government and the high court. We have nothing to hide," Bhat told reporters. He added that the KSCA would provide all necessary support to the ongoing investigation and emphasised that transparency would be maintained throughout the process. The stampede occurred outside the stadium on the evening of June 4 as thousands gathered for the RCB team's celebratory event after winning their maiden IPL title. Defeat in victory: How RCB's rushed Bengaluru parade ended in deaths
The victory celebrations in Bengaluru of the long-awaited IPL win by the Royal Challengers Bengaluru (RCB) had broken out well before midnight on June 3. From the city's central hangouts around MG Road to bustling residential neighbourhoods, whose watering holes and clubs were packed, fans had taken to the streets, some on foot, others hollering past in vehicles. When the central business district had finally been cleared of revellers, it was past 3 am. For the city's police force, it was akin to the frenzy every New Years' what lay in store for them the following afternoon was of an entirely different order. Primarily because it all happened at short notice, leaving little time to prepare for the tsunami of fans that hit central Bengaluru on June 4. A stampede and 11 deaths M. Chinnaswamy Cricket Stadium, the RCB's home ground, has a seating capacity of 35,000. On a usual match day, the crowd runs into a few extra thousands, accounting for those who land up without tickets in hand. Hence, crowd management on those days isn't as much a worry as maintaining traffic flow, points out a police officer. But on June 4, approximately 200,000 to 300,000 fans had trooped in for the RCB victory celebration, details of which had been sketchy from the police had apparently shot down the original plan, which was a victory parade from the city's old HAL airport—where the RCB team had touched down—all the way to the state secretariat, Vidhana Soudha, located in the heart of Bengaluru. But it appears they had no such luck with the alternate plan that was eventually charted. This involved a reception on the grand steps of the Vidhana Soudha, followed by a parade around the block to the nearby Chinnaswamy By mid-afternoon, even as the felicitation was underway, tragedy was unfolding at the stadium gates where huge crowds were trying to get in. The youngest of the 11 victims was a schoolgirl aged 14 whose mother had brought her to the stadium as a a backlash and under attack from the Opposition parties, the Siddaramaiah-led Congress government, on June 5, ordered the arrest of representatives of RCB, Karnataka State Cricket Association (KSCA) and event managing firm DNA. Alongside, chief minister Siddaramaiah took the unprecedented step of placing the Bengaluru City police commissioner under suspension for dereliction of duty, along with four other police officers. Retired judge, Justice John Michael Cunha, has been asked to hold an inquiry and report in 30 to the suspension order, the CEO of RCB had informed the police commissioner on June 3 about holding a victory parade. 'However, the office of the police commissioner failed to give written reply to the organisers, rejecting the permission on the grounds of lack of time to prepare for such a huge event,' the order said.'The RCB and the [Karnataka State] Cricket Association went ahead to tweet about the celebrations and inviting fans to the Chinnaswamy Stadium without going through the usual practice of issue of tickets or passes. Despite the knowledge of these developments and expectation of huge turnout of cricket fans by the police, steps were not taken to either have the event organised systematically at the stadium or give adequate information to the public to take necessary precautions for their safety or provide additional police force for appropriate crowd management,' the order parties have accused the Siddaramaiah government of rushing to hold a felicitation. 'In the wake of severe public backlash and outrage over Bengaluru stampede, the government is now desperately looking for scapegoats,' said the BJP's R. Ashoka, who is leader of the Opposition in the legislative Union minster H.D. Kumaraswamy, also state president of the Janata Dal (Secular), held a press conference in New Delhi on the night of June 4, where he blamed his rival and Karnataka deputy chief minister D.K. Shivakumar for the tragedy. 'What was the rush to organise a felicitation event immediately? Who invited the team? Why this urgency? Everyone knows the role the deputy CM played in all this,' Kumaraswamy said, pointing out that Shivakumar had also gone to the HAL airport to receive the RCB ascertain the reasons that led to the tragedy and whether it could have been prevented, the Karnataka High Court registered a suo motu writ petition on June 5. It has asked the government to file a status-report answering nine points, ranging from who took the decision to hold the victory celebration to whether any standard operating procedures had been formulated to manage large crowds in events of this nature. The court will resume the hearing on June 10.A police officer said paucity of time was the biggest reason for such a tragedy.
