Drunk driver sentenced to probation for 2023 crash in Delaware County
DELHI, N.Y. (WIVT/WBGH) – A Brooklyn man was sentenced to probation for his involvement in a 2023 crash that injured three people.
Delaware County District Attorney Shawn Smith announced that 50-year-old Andras Kasuba appeared in court on Tuesday and was sentenced to time served to be followed by five years of probation supervision for Aggravated Vehicular Assault, a Class C Felony, and Driving While Intoxicated, First Offense, an Unclassified Misdemeanor.
On March 18, 2023, Deputy Lucas Elmore of the Delaware County Sheriff's Office responded to a motor vehicle crash on Highway 26 just north of Gregory Hollow Road. Upon arrival, Elmore identified Kasuba as a driver of one of the involved vehicles. As a result of the crash, three individuals needed extraction by helicopter due to serious physical injuries. Elmore determined that Kasuba was intoxicated at the time of the crash. It was later revealed that Kasuba had a blood alcohol content of 2.5 times the legal limit.
Kasuba was arraigned on May 2, 2023, in the Town of Colchester. After this appearance, Kasuba fled Delaware County. He was also the subject of a deportation proceeding in which he also failed to appear. The New York City Police Department eventually located and apprehended Kasuba in Brooklyn. He was arraigned in the Delaware County Court on June 16, 2024.
As part of a plea deal, Kasuba admitted that he was driving drunk the day of the crash, injuring three people due to his actions.
During Kasuba's appearance on February 4, First Assistant District Attorney Schuyler Konior Kinneman requested the imposition of the agreed-upon sentence, noting that Immigration and Customs Enforcement (ICE) had placed a detainer warrant on Kasuba.
Kinneman also read impact statements, saying that at least one of the victims feels intense anxiety whenever she gets in a car. He also said all three of the victims had injuries that resulted in medical evacuations to Albany.
Kinneman said the situation was a tragedy and that he hoped Kasuba would use probation to get sober. He also said that if Kasuba was deported to Hungary, he hopes that he seeks immediate care for his addiction there.
Judge John Hubbard sentenced Kasuba to time served, about eight months, and five years of felony probation supervision. Hubbard agreed with the People that the case was truly a tragedy for all involved and that he hoped Kasuba would seek treatment.
'I want to thank Deputy Lucas Elmore for his fine work in bringing criminal charges against Andras Kasuba. I want to further thank the officers of the NYPD for assisting us in apprehending Mr. Kasuba when he decided to flee,' said Smith. 'Our office remains dedicated to tracking down every defendant who thinks he can wait out charges. As Mr. Kasuba found out, charges don't go away when you run from them.'
