Through Sheboygan-based firm Rohde and Dales, eight residents living near the project filed a lawsuit Jan. 31 in Sheboygan County Circuit Court against the City Plan Commission and Sheboygan Zoning Board of Appeals for approving a one-year extension of Kohler Co.'s 2020 conditional use permit and not accepting of the plaintiff's appeals for review, respectively. Most of the plaintiffs live within one-quarter to three-quarters of a mile of the proposed golf course site. One lives directly adjacent. In the civil complaint, the attorneys propose several paths that would allow for a review and possible overturn of the Commission and Board of Appeals decisions. 'This case is simply about the City of Sheboygan following its ordinances, state law statutes, and the terms of the conditional use permit issued to Kohler Company,' Rohde and Dales attorneys said in a statement to the Sheboygan Press. 'We look forward to upholding the law and ensuring that the city does so as well.' At the Nov. 14 meeting, Deborah Tomczyk, an attorney representing Kohler Co., said the company was seeking a 'simple request' to extend the permit to allow for redesigning the golf course plan. This is necessary in part because a Wisconsin Court of Appeals upheld a decision denying the company a wetland fill permit, determining the Wisconsin Department of Natural Resources, among several factors, didn't have sufficient evidence to grant it in 2018. This was one of seven cases not ruled in the company's favor. Tomczyk said in a letter to the city the golf course revision would include eliminating 'all direct impacts on wetlands and avoid all wetland filling.' Several community members, including members of the Friends of the Black River Forest, who were central in the fight against the project, said in public comment not being able to obtain a wetland fill permit for the first proposal essentially results in a new project and warrants a new CUP application and site plan. The Commission approved the permit extension to Dec. 4, 2025. Common Council approves obtaining outside legal counsel because city attorney is named in lawsuit The Common Council approved Feb. 17 obtaining outside counsel with Madison-based firm Boardman & Clark. To Alder John Belanger's question about why the city was seeking outside counsel, City Administrator Casey Bradley explained that part of City Attorney Charles Adams' recommendation to the Commission during discussion is part of the lawsuit. Alders were wary at the Feb. 10 Finance and Personnel Committee meeting about the project taking a turn to another legal dispute. Alder Dean Dekker said he feels the city is in a 'rock and a hard spot.' 'How far do you think this can go?' Dekker asked Adams. 'To be honest with you, if the Planning Commission hadn't done as they had done, we would be being sued by the Kohler Company. What are we supposed to do?' Adams agreed with Dekker, adding the Plan Commission's decision was the 'better' decision for the city. 'I think it's going to be much more defensible given that,' he said. Alder Robert La Fave expressed concern about the optics of the city pursuing legal action and asked if the city could face pushback from the Friends of the Black River Forest, which had been active in previous legal efforts but is not a party to this case. Adams clarified the purpose of the agenda item was whether to obtain legal counsel, not mull over strategies. He thought it unlikely another lawsuit would be brought forth about the conditional use permit extension. 'For the most part, time has passed, so this is likely the one case relating to that extension,' Adams said. 'There won't be other ones most likely.' Mayor Ryan Sorenson provided a comment to the Sheboygan Press about the lawsuit, too, saying the Plan Commission did not approve the project but rather extended the current CUP. 'I still have many outstanding questions about the overall potential changes in the project," Sorenson said. "The Plan Commission needs to better understand the impact of clearcutting a forest right on Lake Michigan, right next to a state park. The environmental and wetland impact needs to be thoroughly examined, and we still do not know how the changes will impact the Native American burial grounds. 'Additionally, the city needs to better understand the longer-term impact on the infrastructure costs for this project,' he continued. 'These are all factors we can consider in the state statutes. In the next steps, the applicant will have to be transparent about these matters." No documents have been filed on behalf of the defense, as of Feb. 21. Sarah Zylstra, one of Boardman & Clark's attorneys working on behalf of the city, declined to comment because of pending litigation. Tomczyk also did not respond to a request for comment. City Plan Commission approved an extension for an 'expired' CUP, according to the complaint In the complaint, the residents' attorneys took issue with several aspects of the City Plan Commission's Nov. 12 approval to extend the permit. The permit, granted in 2020, included a tolling provision that delayed any action on the project until litigation concluded, 'provided the applicant proceeds to develop the property consistent with the approved conditional use permit and site plan.' The permit limit would begin when the cases finished, according to the CUP conditions, which was Dec. 4, 2023, according to the Plan Commission agenda. Kohler Company had a year to begin construction. But the complaint said the CUP was 'ostensibly 'tolled.'" 'The CUP had already expired at the time that the Plan Commission ostensibly granted a one-year extension of the CUP, and thus the Plan Commission acted without authority,' the complaint said. The complaint cites the permit, saying revised site plans must be submitted as a new CUP application to the commission for approval before construction can begin, which the company did not do ahead of the Nov. 14 meeting. The 2020 CUP also requires a wetland fill permit be obtained, the complaint said, and the site plan also needs amendments with consideration 'including but not limited to environmental changes caused by the changing water levels of Lake Michigan and the denial of a wetland fill permit.' The complaint also said Commissioner John Belanger, who 'voiced strong support' of Kohler Company and the project and voted in favor of the extension, should've recused himself from the vote because he had a conflict of interest as a Kohler Company employee. Belanger, who is running for mayor in the April 1 election, declined to comment, but he shared he retired from Kohler Company at the beginning of February. Commission member Braden Schmidt, who also works for Kohler Company, abstained from the vote in November. The complaint said granting the one-year extension was 'deficient, was erroneous, was arbitrary, was oppressive, was unreasonable, was based on incorrect theories of law, included the vote of a member who had a conflict of interest due to his employment with Kohler, and was not supported by evidence, and represented the Plan Commission's will and not its judgment.' Zoning Board of Appeals says it didn\'t have \'authority\' to review an appeal of the CUP extension Roger Miller, who spoke against the permit extension, filed a Dec. 16 appeal to the Sheboygan Zoning Board of Appeals of the one-year CUP extension, but Chairman Kevin Sampson said the BOA did not have "authority" to hear his appeal, according to a letter in the complaint. The complaint also alleges Adams 'ghost wrote' Sampson's letter to Miller after advising BOA. Adams was in discussion with the commission at the Nov. 14 meeting. 'It was inappropriate for Adams to advise both the Plan Commission and the BOA,' the complaint said. 'Because BOA was asked to review a decision of the Plan Commission. Adams should have referred the BOA and Sampson to other legal counsel to respond to Miller's appeal.' In the response to Miller, the letter said the issue should be taken up in circuit court because BOA can only hear appeals for decisions made by the zoning administrator or "any other administrative official." But the state statute and city ordinance the letter referenced only applies to individuals who applied for the conditional use permit, the complaint said, which doesn't apply to the plaintiffs. The complaint said the board does have jurisdiction to hear the appeal given that state statute 62.23(7)(e) gives it 'broad authority to review the decisions of municipal actors as those decisions apply to a municipality's zoning ordinances.'
