Hong Kong 47: Jimmy Sham, 3 other pro-democracy figures, released from prison

Jimmy Sham Tsz-kit, one of the 47 Hong Kong pro-democracy figures charged in the city's largest national security case, has been released from prison after serving his sentence for conspiracy to commit subversion. Sham and three others – Kinda Li Ka-tat, Roy Tam Hoi-pong, and Henry Wong Pak-yu -were released early on Friday, a police source confirmed. They were the second batch of defendants in the high-profile case to complete their sentences. Sham, 38, a former convenor of the now-defunct Civil Human Rights Front, was sentenced to 4 years and 3 months in prison in November 2024, with the time he spent in pre-trial detention also taken into account. He was seen emerging from Shek Pik Prison on Lantau Island under heavy police escort, and also near his residence in Jordan, where he arrived at around 6.30am, according to local media reports. 'Let me spend some time with my family first, we can talk in the afternoon,' he said, nodding and smiling at reporters at the scene. Li, Tam and Wong, who are all former district councillors, were also released around the same time – Li and Wong from Stanley Prison, Tam from Pik Uk Correctional Institution.

A Hong Kong appellate court has questioned how authorities' denial of a prisoner's early release from jail under the domestic national security law constitutes a violation of human rights, noting that sentence reductions are not an entitlement. The Court of Appeal also highlighted on Friday that it had no power to compel the Correctional Services Department to accept the plea for immediate release from Adam Ma Chun-man, the prisoner behind the first legal challenge against the Safeguarding National Security Ordinance. Ma, a former food delivery worker, has lodged an appeal against the Court of First Instance's dismissal of his judicial review over a prison rule that would bar most national security offenders from early discharge. The applicant, who was dubbed the 'second-generation Captain America' for dressing as the Marvel character in the 2019 anti-government protests , is serving a five-year sentence at Lantau Island's Tong Fuk Correctional Institution for promoting Hong Kong independence through the chanting of slogans in public and in media interviews. He had expected to be released on March 25 last year, as prisoners generally had their sentences cut by a third for good conduct while in custody. But the ordinance, mandated under Article 23 of the Basic Law, the city's mini-constitution, stipulates that a national security offender 'must not be granted remission' unless the commissioner of correctional services is satisfied the move will not compromise national security.

Advertisement Hong Kong Observatory issued an amber rainstorm warning at lunchtime on Wednesday, with the forecaster urging the public to brace for widespread heavy rain and possible flooding in the next few hours. 'A trough of low pressure is bringing showers and thunderstorms to the vicinity of the Pearl River Estuary persistently,' it said. 'Locally, around 10mm of rainfall was recorded over many places this morning, and rainfall even exceeded 30mm over parts of New Territories West and Lantau Island.' An amber rainstorm warning means heavy rain exceeding 30mm has fallen or is expected to fall in an hour. The last such signal was issued on April 25. Advertisement The Observatory said rainfall was likely to be particularly heavy in the Tsuen Wan area, potentially causing serious flooding.
