Habeas corpus for daughter lands man in Pocso soup
Representative image BHOPAL/JABALPUR: Madhya Pradesh HC has ordered an FIR under the Pocso Act against a man who filed a habeas corpus petition to find his "missing" minor daughter. When she was produced in court, however, she refused to go back to her father, accusing him of "sexual advances", and said she would rather live with her female friend with whom she had run away from home. The bench of Justice Atul Shreedharan and Justice Anuradha Shukla, in a recent order, sent the 17-year-old to Nari Niketan till she turns an adult. The court, however, said that the girl may have accused her father out of vendetta so police should not arrest him until necessary. The girl went missing in April. Her father filed a habeas corpus plea after police failed to trace her despite an FIR in which he named a person who might be keeping her "hostage". Following an HC directive, police tracked her down and produced her in court on April 21, 2025. In her statement before judges, she said her father had got her married to a person for Rs 1 lakh. She added that she doesn't want to live with her father because she doesn't feel safe. She alleged that he used to touch her inappropriately when she was asleep. He was always drunk and would misbehave with her, she said, adding she had runaway with a friend and wanted to live only with her. The court, in its April 25 order, noted that the girl had levelled serious charges against her father hence police should register a case . However, he should be arrested only when police are convinced that the girl's charges hold water following probe, the bench said. Till she turns 18, the girl will stay in a 'Nari Niketan'. After that, she would have the liberty to decide what she wants to do.

Madhya Pradesh HC puts NEET-UG results on hold
INDORE: Madhya Pradesh HC 's Indore Bench Thursday ordered a temporary halt on the declaration of NEET-UG 2025 examination results due to controversy over power failure at a centre. The bench of Justice Subodh Abhyankar noted in its interim order that no representatives had appeared for the respondents ( National Testing Agency ) or Union of India despite a May 13 court order to take instructions on the matter. The stay could potentially impact nearly 21 lakh NEET-UG candidates nationwide, as HC has not limited its directive to specific examination centres or regions. The next hearing is in around four weeks. With no backup power systems in place, candidates had to continue their examination in minimal lighting conditions, the petition said, adding emergency lighting (candles) were arranged only around 4.30pm, with just 30 minutes left on the clock. The petition sought either a re-examination for the affected candidates or alternative remedial measures to ensure fair assessment. HC said: '...Respondent(s) have failed to provide proper conditions to the petitioner, who was appearing in NEET-UG examination, which was held on 04.05.2025, and was prevented due to power failure in various parts of the city, it is directed that till the next date of hearing, the result shall not be declared by the respondents.'

Rape case: Couple agree to marry, exchange flowers in Supreme Court
The Supreme Court Thursday suspended the the 10-year sentence of a man convicted of rape on false promise of marriage after he and the woman expressed willingness to marry each other. A bench of Justices B V Nagarathna and S C Sharma also persuaded the couple to exchange flowers in the court. Advocate Mrinal Gopal Eker, appearing for the state of Madhya Pradesh, said that the court itself arranged the flowers. The SC order said, 'Having regard to the sensitivity of the matter, we directed the parties as well as their parents along with their respective learned counsel and learned standing counsel for the State of Madhya Pradesh to appear before us in chamber. They have appeared before us in chamber in the pre-lunch session. We heard them.' 'We passed over the matter so as to enable the parties to have a dialogue and inform the court as to whether they are inclined to get engaged and be married to each other. In the post-lunch session, the matter was again called in the court hall. The petitioner and respondent No.2 have unequivocally stated before us that they are willing to marry each other,' it said. The top court said that the details of marriage will be worked out by their respective parents and hoped that the marriage takes place expeditiously. The convict will return to jail and be produced before the sessions court concerned which will release him on bail, subject to such conditions as it may deem appropriate, the top court said. As per the prosecution, the couple came in contact on Facebook and had physical relations between 2016 and 2021. The woman claimed that he had assured to marry her but backtracked following which he was charged with rape and convicted. On September 5, 2024 , the Jabalpur bench of the Madhya Pradesh HC rejected his application under Section 389(1) of the CrPC for suspension of sentence, following which he moved the top court.
