From floor count to parking: MahaRERA's new project registration certificate gives homebuyers all the info upfront
The Maharashtra Real Estate Regulatory Authority (MahaRERA) has taken a homebuyer-friendly step by introducing a more detailed project registration certificate to enhance transparency in the real estate sector. The new certificate will include key project details such as the total built-up area, names and numbers of buildings and wings, the total number of approved habitable floors, residential and non-residential units, approved floors for construction, and the number of parking slots available for four-wheelers, two-wheelers, and visitors. This move aims to simplify project information and empower homebuyers to make more informed decisions. According to MahaRERA, homebuyers will now be able to access key information about a real estate project directly through the registration certificate and its annexure, eliminating the need to sift through multiple documents on the portal. "This homebuyer-centric step has been taken by MahaRERA after taking into account the essential preliminary information a homebuyer needs pertaining to a housing project. The decision will be applicable with immediate effect for all the new housing projects," MahaRERA said in a statement. According to MahaRERA, the earlier version of the registration certificate included only basic details such as the project name and the promoter's name and address. "In the new registration certificate, details such as project's total built-up area, name and number of the buildings and wings, total number of approved habitable floors, total number of residential and non-residential units, total number of floors approved for construction and total number of parking slots available for four-wheelers, two-wheelers and visitors will also be included," the MahaRERA said in the statement. According to MahaRERA, the project registration certificate will be updated periodically. "If there are any updates in the project's information, such as an extension of the timeline, transferring the project to another developer, or corrections in the project, the updates will get reflected in the revised certificate," the MahaRERA said. MahaRERA said that a new registration certificate will be issued for projects already registered, including crucial information, which will significantly benefit homebuyers. MahaRERA stated that the annexure to the new registration certificate will now also include details from the Commencement Certificate (CC), such as the approved construction height (floor-wise) and the total number of parking spaces. Additionally, if a developer makes any changes during the project lifecycle, such as revising deadlines, entering into a joint venture, or transferring the project to another company, these updates will be reflected in a revised MahaRERA certificate issued for the project. MahaRERA has also mandated that all advertisements across media platforms must display a QR code containing key preliminary project information along with the project registration number. Scanning this QR code will allow homebuyers to quickly access essential project details. To ensure this investment is safe and secure, MahaRERA has been committed to protecting homebuyers' rights. With this objective and to address potential future challenges, the authority has started issuing project registration numbers only after conducting thorough legal, financial, and technical scrutiny. 'MahaRERA has initiated including key project details on registration certificates issued for new housing projects,' said chairman Manoj Saunik. 'These details cover the project's total built-up area, names of the buildings and wings, and the total number of floors approved for construction. We consistently urge homebuyers to review these details carefully and verify all legal aspects before making any decision or transaction.' Pune-based developer Rahul Ajmera of Vasupujya Corporation said, 'Any move that empowers homebuyers is a welcome step. It also makes it easier for real estate developers to share relevant information. At the same time, MahaRERA could further simplify its website in the coming months to improve the flow of information to homebuyers.'

With this, the new certificates will offer essential project information in a simple, bullet-point format for easy reading and better understanding. Until now, the MahaRERA registration certificate only carried basic details such as the project's and promoter's name and address in a single-line format. However, with this new decision, the certificate and its annexure will now reflect crucial project specifics, including the total built-up area, the name and number of buildings and wings, the total number of habitable floors, residential and non-residential units, construction approvals, and available parking for four-wheelers, two-wheelers, and visitors. The decision, which comes into effect immediately, aims to make preliminary information easily accessible for potential homebuyers. In case of any amendments to the project—such as an extension of completion timelines, corrections, or a transfer of the project to another developer—the revised certificate will also reflect the updated information. MahaRERA Chairman Shri Manoj Saunik emphasised the importance of protecting homebuyers' rights, noting that most buyers invest their lifetime savings into purchasing a home. 'To ensure this investment remains safe and secure, MahaRERA is committed to legally empowering the homebuyer. The new registration certificate is a major step forward in providing clear, verified, and detailed project information upfront," he said. He added that these certificates will help guide buyers in making informed decisions by allowing them to verify legal, financial, and technical project details before entering any transaction. 'As part of our commitment, we have already introduced measures such as a Standardised Agreement for Sale, standardised allotment letters, and mandatory disclosure of parking slot dimensions and amenities with delivery timelines. These have set new benchmarks in real estate regulation, and many other States have adopted these practices," he explained. Further, MahaRERA has already made it compulsory to display these certificates at the project site and on the project's website. When users search for a project on the MahaRERA website using the registration number, a link to the certificate will now appear on the first page. Advertisements must also carry a QR code that links directly to key project information for easy access. HC stays MahaRERA order to appoint new developer for Anantya SRA
MUMBAI: The Bombay high court recently stayed an order passed by the Maharashtra Real Estate Regulatory Authority (MahaRERA) that allowed a new developer, Chandak Realtors, to take up a slum rehabilitation project in Kurla without addressing the rights of previous stakeholders. Initially, Radius & Deserve Builders LLP was appointed as the developer for the Anantya slum rehabilitation project, which involved the construction of free sale buildings and housing for slum dwellers. Later, Capacit'e Infraprojects Ltd was appointed as a contractor to carry out civil engineering and construction work. As part of the agreement, Capacit'e was allotted 10 flats in the project. However, due to pending corporate insolvency proceedings against Radius & Deserve, the Slum Rehabilitation Authority (SRA) in September 2021 appointed Chandak Realtors Pvt Ltd as the new developer. Subsequently, Chandak approached MahaRERA in September 2022 seeking a fresh registration of the project, arguing that the liabilities created by Radius should not be imposed on it. In March 2023, MahaRERA approved the fresh registration of the project. Capacit'e then challenged the order, arguing that it was passed under a suo-moto (on its own) proceeding despite the matter under consideration being an application filed by Chandak. 'A suo-moto power to be exercised, in such circumstances, cannot be traced under the RERA Act and that too by constituting a full bench so as to pass such [an] order,' senior advocate Sharan Jagtiani, representing Capacit'e, told the court. He further objected to the blanket observations made in the order, which he said completely obliterates Capacit'e's rights to the 10 flats granted by the previous developer. Senior advocate Ravi Kadam, representing Chandak Realtors, contended that Capacit'e's claims stand against Radius and not Chandak. Therefore, whatever rights Capacit'e has with respect to Radius cannot be asserted on Chandak, he said. The division bench of justices GS Kulkarni and Advait Sethna found prima facie substance in Capacit'e's contentions and granted a stay on the MahaRERA order. The bench questioned the suo-moto aspect of the case, considering the application was moved on behalf of Chandak. 'Considering the provisions of the RERA Act, prima facie, we do not find any such powers being conferred on the authority to constitute such [a] full bench and pass such orders as suo moto orders,' it said. 'Prima facie the reading of the impugned order, so as to fall outside the provisions of the RERA Act, also does not appeal to us, more particularly for the reason that such [an] order could not have been passed in complete violation of the principles of natural justice, when it categorically affects the third parties like the petitioner,' it added.

New MahaRERA registration certificates will contain all vital details of housing project
MUMBAI: In another move to protect homebuyers and ensure transparency in builders' projects, state housing regulator MahaRERA has decided to issue registration certificates that will contain crucial details about housing projects. The information includes the project's total built-up area, the number of wings, buildings and their names, the commencement certificate showing the number of approved habitable floors, the number of residential and non-residential units and the total number of car and bike parking slots along with the developer's name and address. At present, the registration certificate mentions only the builder's name and project address in a single line. In a press release, the housing regulator said that buyers and others could now get all this vital information simply by scanning the certificate. This decision will be applicable with immediate effect for all new projects. During a project's life-cycle, if the builder makes changes to the project, such as seeking a deadline revision or entering into a joint venture or transferring the project to another company, these details will get reflected in the revised MahaRERA certificate issued to him. The press note said that all builders would have to display the certificate at the site as well as on their website. MahaRERA has already asked builders to get a QR code—containing the project's essential preliminary information—along with the project registration number in advertisements across all media. 'Most people invest their lifetime savings in purchasing a property,' said MahaRERA chairman Manoj Saunik. 'To ensure that the investment remains secure, MahaRERA has been striving to protect homebuyers' rights. With this in mind and the potential challenges that may arise in the future, MahaRERA has initiated granting registration numbers of projects only after thorough legal, financial and technical scrutiny. We have also announced non-negotiable provisions related to the Standardised Agreement for Sale as well as the allotment letter, parking and amenities.' Saunik said that through these efforts, MahaRERA aimed to bring in transparency and accountability among real estate's stakeholders. 'We always urge and encourage the homebuyer to understand all these details carefully and verify the legal details prior to making any decision or transaction,' he added.

Mumbai: No relief for six defaulter flat buyers in Chembur project
MUMBAI : In a recent order, MahaRERA granted no relief to six flat purchasers, stating that since they defaulted on payments, they were not entitled to the relief they sought under the Real Estate (Regulation and Development) Act. Of the six flat purchasers, five sought a refund of certain amounts they paid as they wished to withdraw from the residential project in Chembur , and one wanted to continue but sought more time to pay. Godrej Developers terminated their bookings by seeking to forfeit the booking amounts. The allottees challenged the forfeiture and sought a refund under Section 18 of the RERA Act on the grounds of wanting to withdraw from the project. One of the buyers who filed the complaint before MahaRERA said he wanted to withdraw from the project and sought orders to direct the builder to refund the amount, as due to the Covid pandemic at the time, he was unable to invest huge sums in the project. All complainants said they suffered financial and personal loss during the Covid-19 pandemic, the effects of which they are facing even today. Advocate Pulkit Agarwal, representing four complainants, argued that they wished to withdraw since the builder served them termination letters, "stating that the entire amount that the complainant paid stands forfeited and the complainants were ordered to return all the documents regarding their units". For Godrej, advocate Abhijeet Mangade argued that the reliefs claimed by individual complainants were not based on any violation or non-compliance of RERA Act by the developer, but the buyers failed to pay on time. MahaRERA chairperson, Manoj Saunik, in his order, said since the allottees defaulted on their obligations by failing to make remaining payments on time as per the agreement, "the authority finds that the six complainants are not entitled to reliefs under Section 18". MahaRERA upheld the termination notice sent by the builder to the buyer with whom an agreement was made, but directed a refund of money strictly according to the terms of the agreement to the buyer in 60 days. MahaRERA said it was pertinent to note that under Section 19(6), the allottee is under obligation to make timely payments in the manner prescribed in the agreement. One of the functions of the authority is to ensure compliance with the obligations cast upon the allottees. The Chembur project got part occupancy certificates in March 2022 and Dec 2023.
