Maharashtra women and child development minister Aditi Tatkare posted the decision on her X handle on Friday. The decision followed a comprehensive social investigation report from the district child protection officer.
"The report stated that her (Swati Kaspate's) social, emotional and family environment was conducive to the child's welfare and so she has been deemed the appropriate person to take care of the child.
The complete responsibility for the child's education, health and overall development will rest with Kaspate," stated the minister's tweet.
According to the Juvenile Justice Act, the CWC can appoint a fit person to take care of a child if biological parents are not present or admit him/her to a child care unit.
District collector Jitendra Dudi told TOI that the custody order of Vaishnavi's child was passed based on the social investigation report submitted by the district child protection officer, after proper investigation.
"The order to give custody of the child to the maternal grandmother was taken after home visits only," he said.
"Under Section 52 (1) of the Juvenile Justice Act, 2015 (amended 2021), and the Rule 30 (1) of the Maharashtra State Juvenile Justice Rules, 2018, the custody of the child has been retained with Kaspate so that he is properly taken care of. As a fit person, Kaspate should fully consider the safety, education , health and overall development of the child," the order stated.
