When comments are vulgar, humiliating, inappropriate, disrespectful and offensive, they are contemptuous — Hafiz Hassan

JUNE 1 — The Attorney-General's Chambers (AGC) announced on Friday (May 30) that it would pursue contempt of court proceedings against senior lawyer Shafee Abdullah, over his 'Nazi Germany' reference regarding ex-prime minister Najib Abdul Razak's royal addendum case. In its statement, the AGC said Shafee's remark was made in the context of an ongoing case, and 'constitutes a serious and unwarranted attack' on the dignity, authority and independence of the Judiciary. Is there a legal basis for contempt of court proceedings against Shafee? Let's recall the case of Peguam Negara Malaysia v Mkini Dotcom Sdn Bhd [2021]. The facts in that case are straightforward. Malaysiakini published an article on June 9, 2020 about the acquittal of former Sabah Chief Minister Musa Aman of 46 charges of corruption and money laundering. Coincidentally on the same day, the Office of the Chief Registrar issued a press release by the Chief Justice for all courts to be fully operational from July 1, 2020, in line with the announcement that the country was moving into the recovery phase of the Movement Control Order (MCO). Malaysiakini republished from Bernama that press release as an article. Following that press release, a number of comments (impugned comments) by third party online subscribers appeared on Malaysiakini's website on the same day. A week after, the Attorney General by way of an ex parte notice of motion applied for leave to commence committal proceedings against the publisher of Malaysiakini as the first respondent and its editor in chief as the second respondent for publishing the impugned comments. The rest, as they say it, is history. By a majority (2:1), the Federal Court found the first respondent, but not the second respondent, guilty of contempt of court. Contempt of court is a generic term descriptive of conduct which tends to undermine proceedings in a court of law and can take many forms. The law on contempt is not to protect the dignity of individual judges but to protect the administration of justice. The courts cannot permit any interference with the due administration of justice. Its purpose is to maintain public confidence in the administration of justice. Accordingly, criticisms of judges as individuals, rather than as judges, are not the subject of contempt. In Malaysiakini's case the impugned comments, which need not be repeated here, were beyond doubt contemptuous in nature. The respondents themselves admitted that the comments were indeed offensive, inappropriate, disrespectful and contemptuous. Both duly regretted their publication and put it on record that they did not condone them. When comments are vulgar, humiliating and offensive, they go beyond justified criticisms and amount to simple insults. No one in the right frame of mind can say that such comments are done in exercise of freedom of expression and therefore protected. A day after his Nazi Germany reference, Shafee, through his legal firm, clarified the remarks. Madiga MLAs intensify demand for Cabinet berth

Hyderabad: With high speculation of Cabinet expansion within days, the Madiga MLAs who have been urging for their due share, intensified their demand on Wednesday. The MLAs who have on several occasions represented matters at AICC level called on Chief Minister A Revanth Reddy and also Meenakshi Natarajan, the AICC State incharge. The six MLAs who submitted their representation to CM, later met the AICC in-charge at MLA Quarters under the leadership of Adluri Laxman Kumar, the Dharmapuri MLA. While claiming that the Madigas be given proper representation in the Cabinet as per the proportion of their population in the State, they have been raising their pitch for the past few months. This development comes a day after the MLAs held a meeting, where they discussed their plan of action for pursuing the demand. This meeting was attended by Manakondur MLA Kavvampally Satyanarayana, Thungathurthi MLA Mandula Samuel, Chevella MLA Kale Yadaiah and Nakrekal MLA Vemula Veeresham, the latter two participated virtually. They have planned to meet AICC top brass including Mallikarjun Kharge, Rahul Gandhi and also KC Venugopal, while reminding them of the social justice norm of the party. They have intensified their demand following the speculation that Gaddam Vivek's name was under consideration, which represents the Mala community. For the past few months, particularly after the Congress government has passed the resolution 42 per cent BC reservation, the groups including Madiga, Lambada (ST) and besides BCs are fighting it out in favour of their respective communities in the cabinet.

SATA honours Mala Lutchmanan and Fakir Hassen with Lifetime Achievement Awards

'Through her unwavering dedication to promoting Tamil language, arts, and identity, Mala became more than a broadcaster. She became a bridge between generations, a source of pride, and an icon in our cultural journey. Though she is no longer with us in person, her spirit lives on through every song, every word, and every life she inspired. In recognition of her immeasurable contributions, we are humbled to confer this Lifetime Achievement Award posthumously,' Shulochan added. "Some voices don't fade… even in silence, they echo. Today, we pause to honour the life and legacy of a formidable voice, a champion of Tamil culture, and a beloved stalwart of South African radio, the late Mala Lutchmanan,' said MC Shasti Shulochan. The event featured a range of cultural items from mainly the expatriate Tamil community that SATA represents and a few local artists. THE Tamil Association of South Africa (SATA) has honoured two stalwarts of the media industry in South Africa, the late Mala Lutchmanan and Fakir Hassen, with Lifetime Achievement Awards when the organisation marked Kalai Thiruvhiza at the Patidar Theatre in Lenasia last Saturday. A video played on stage highlighted the diverse areas that Lutchmanan had been involved in before her award was presented to her nieces - Jay-Sayuri Pillay and Kumoni Pillay - by Elavarasan Varadharajan and Poobalan Les Govender, the Deputy Chairman of the National Council of Provinces. These included Lutchmanan's philanthropic causes, her fervent promotion of the Tamil language and culture, and the many publications that she authored, including the translation of the Thirukkural into isiZulu. The co-MC, Lakshmi Janaki, said Hassen's award was to celebrate, honour, and express SATA's admiration for his contributions across radio, television, and print media. 'We also pay tribute to his legacy as an author, whose body of work will continue to inspire generations to come. With unwavering courage and dedication, he became a chronicler of truth, a beacon of integrity, and a storyteller whose words have transcended borders and time. 'The South African Tamil Association takes immense pride in honouring Mr Fakir Hassen with the Lifetime Achievement Award - a recognition not only for his distinguished career but also for the profound impact he has had on countless lives, the generations he has mentored, and the rich stories he has preserved for posterity,' Janaki said before India's High Commissioner to South Africa, Prabhat Kumar, presented him with his award. SATA President, Ramnath Arunachalam, said the new Tamil migrants to South Africa had made a connection with their local counterparts, who have been here for 165 years, through Lotus FM, especially through Lutchmanan's programmes. 'That was a big connection for us because Mala was the only person who spoke fluent Tamil. I called her in December last year and she was very happy when I told her that we wanted to give her this award. Unfortunately, she passed on in February, but we kept to our word with the posthumous award,' Arunachalam said. 'Our chief patron is the Consul General of India, who recommended Fakir Hassen for the second award, which we supported fully because he cuts across languages and has promoted not just Tamil culture, but Indian culture across the globe through his work for nearly five decades now. We also learnt that he was the station manager, who first gave Mala her job. These awards were our way of saying thank you to the South African community that has given us so much." Both Govender and Hassen, in their addresses, made a plea for SATA and the local South African Tamil Federation to unite to create a broader platform to promote Tamil arts and culture. THE POST

Karnataka Mala Mahasabha advises people of sub-caste to clearly mention caste name in SC census

Ravindranath Patti, a leader of Karnataka Mala Mahasabha, has appealed to people of the sub-caste of the scheduled caste (right wing) to mention clearly the sub-caste in the specific column in the caste census. The caste census survey commenced on May 5 and will conclude on May 17. Enumerators will conduct the exercise in phases: first, they will go door-to-door, then they will organise special camps, and later offer an online self-declaration option. The government of Karnataka has formed a one-member commission, headed by retired High Court Judge H.N. Nagamohan Das, to oversee the process following directions of the Supreme Court to implement internal reservation among SCs. 'The people of the sub-caste of the right wing of the scheduled caste should clearly mention in the specific column as Chalavadi, Mala, Byagar, and Holeya. The population size will change if community people mention the sub-caste name improperly,' Mr. Patti said.
