Law Talk: Carter v. United States

In this edition of Law Talk, Attorney Megan Collins details the case that questions the Feres Doctrine, which prevents active military personnel from suing the government for injuries that arise out of military service through workplace accidents, negligence of fellow service members, and even medical malpractice at military hospitals.
Carter v. United States challenged the doctrine when Ryan Carter, a dual-status military technician, whose service abruptly ended due to injury. Carter's injury required neck surgery, but left him paralyzed. Carter sued the federal government for medical malpractice by military doctors. The Supreme Court ruled against Carter, citing the Feres Doctrine.
