Man gets 13 years' jail, five strokes for raping stranger
KOTA KINABALU (May 21): A Sessions Court here on Wednesday sentenced an unemployed man to 13 years' jail plus five strokes of the cane for raping a woman Judge Elsie Primus imposed the sentence on Midrick Makales, 30, after he decided to change his not guilty plea to one of guilty under Section 376 (1) of the Penal Code when the case came up for first day of trial. The indictment provides for a jail term of up to 20 years and whipping, upon conviction. Midrick was also ordered to undergo rehabilitative counselling and to be placed under police supervision for three years. He was convicted of raping the 21-year-old woman at a rented room of a shop in Lorong Buah Duku here on January 13. The court heard that Midrick and the victim were strangers and she never talked to him. Both of them were tenants at the rented rooms of the shop. In mitigation, the unrepresented Midrick prayed for a lenient sentence and undertook not to commit a similar offence again. In reply, the prosecution pressed for a heavier sentence on Midrick on the grounds that he will post a threat to society since he had raped a woman, who is stranger.

Kota Kinabalu: The Sessions Court on Tuesday set May 21 to hear the case involving a 30-year-old man charged with raping a woman. Judge Elsie Primus gave the date for Midrick Makales, whose case was brought up for mention to fix the trial date. The court was also informed that Midrick's father could not be located as in previous proceedings. The court ordered his family to make their appearance as the court wanted to know whether the family would engage a counsel to represent Midrick. In previous proceedings, Midrick's trial was postponed due to the last minute application by a counsel to discharge herself from representing him. Midrick had told the court that in previous proceedings, his family was collecting funds to engage a counsel. Midrick is accused of raping the 21-year-old woman at 11am on Jan 13, this year, at a rented room of a shop in Lorong Buah Duku, here. The offence, under Section 376(1) of the Penal Code, carries a jail term of up to 20 years, and whipping, on conviction. Lawyer ticked off for wasting court's time

Kota Kinabalu: A Sessions Court judge reprimanded a defence counsel on Wednesday for discharging herself from a criminal case without prior notice, resulting in the postponement of a trial that had been fixed months in advance. The court was scheduled to hear the trial of Midrick Makales who is facing a charge of raping his neighbour. However, the proceedings were when counsel Hannan Raizani informed the court that she wished to discharge herself from representing Midrick saying that she did not receive any instruction from the family and did not receive documents pertaining the case from the family as well as payment. Presiding Judge Elsie Primus expressed frustration over the sudden move, saying the counsel's conduct had wasted valuable court's time. 'If you really want to discharge yourself from representing the accused, you should inform me in advance. I have a lot of cases to hear… not only me but also other judicial officers. 'The court already set the date to hear this case. What am I supposed to do the whole day now? I cleared this date to hear this case. If you had informed the court earlier, I could have set another case. This just wasted my time,' said Elsie. During the proceedings, the prosecution had no objection to the application which had been granted. Midrick who was under remand pending the disposal of his case, told the court that his family is currently collecting money to engage a counsel for him. The court set May 13 for mention of the case and asked Madrick's family to come whether they can find a lawyer or not.
