A Bihar court has sentenced BJP MLA Mishri Lal Yadav and his aide to two years in prison in a 2019 case of criminal intimidation. The order was passed on Tuesday by the MP/MLA court at Darbhanga. The MLA, who represents the district's Alinagar constituency , and his associate Suresh Yadav , were in 2019 accused by a local resident of assault and snatching cash. Darbhanga: ADJ-III-cum-special judge of MP/MLA court, Suman Kumar Diwakar, on Tuesday awarded two-year jail term and a fine of Rs1 lakh each to Alinagar BJP MLA Mishri Lal Yadav and his accomplice Suresh Yadav under IPC 506. Renu Jha, additional public prosecutor (APP) represented the prosecution side. According to Jha, one Umesh Mishra of Samaila village Under Keoti PS had lodged an FIR against the duo on Jan 30, 2019 stating that a day earlier while he was strolling in the morning, the duo along with other associates, started assaulting him. When he opposed this, the MLA hit his head with a sharp-edge weapon and also snatched Rs2,300 from his pocket, he alleged. On Feb 21 this year, the then special judge of MLA/MP court awarded both three month imprisonment and a fine of Rs 500. Later, the duo filed a criminal appeal which was rejected by the special judge on Friday and upheld the punishment awarded to the duo, who were sent to judicial custody. Patna: In a significant judgment, the MP-MLA court in Darbhanga has sentenced BJP MLA Mishri Lal Yadav and co-accused Suresh Yadav to two years of rigorous imprisonment (RI) in a criminal assault case dating back to 2019. It also imposed a fine of Rs 1 lakh on each of them. The verdict was pronounced by District and Additional Sessions Judge Suman Kumar Diwakar, who upheld the lower court's decision, rejecting the appeal filed by Mishri Lal Yadav against his earlier conviction. The case originated from an FIR filed on January 30, 2019, by Umesh Mishra, a resident of Samaila village, alleging assault by the accused. After the investigation, the police filed a charge sheet, and the court took cognisance of the case on April 17, 2020. On February 21, 2024, the lower court convicted Mishri Lal Yadav under Section 323 of the Indian Penal Code (voluntarily causing hurt) and sentenced him to three months of imprisonment and a fine of Rs 500. Dissatisfied with the ruling, the MLA sought a pardon and appeared before the court on May 22, hoping to secure relief. Following the appeals, the court enhanced the punishment. Judge Diwakar sentenced Mishri Lal Yadav and Suresh Yadav to two years of rigorous imprisonment and imposed a fine of Rs 1 lakh on each. In case of default in payment, the accused would have to serve an additional one-year sentence. Both convicts were taken into custody amid tight security and sent to jail following the sentencing. Speaking after the verdict, Mishri Lal Yadav said: 'I respect the court's order. I have been sentenced to two years and fined Rs 1 lakh. I will appeal to the Patna High Court. I have full faith in the judiciary and believe I will get justice.' On the other hand, plaintiff Umesh Mishra expressed satisfaction, stating: 'What is happening is the will of God. We have finally received justice. We are happy.'

Darbhanga: Additional district and sessions judge-III-cum-special judge, MP/MLA court, in Darbhanga on Friday upheld the conviction and sentence of BJP Alinagar MLA Mishri Lal Yadav and his associate Suresh Yadav, ordering their judicial custody for three months. The court rejected the criminal appeal case filed by the BJP MLA and Yadav, against their conviction and three-month jail-term and a fine of Rs 500 awarded by the special judge Karunanidhi Prasad Arya. Court ordered that the punishment will be maintained and sent both the MLA and his accomplice Yadav to judicial custody, as the police had brought the both from prison to the court during the hearing on Friday. On Thursday, they had been forwarded to judicial custody. The complainant, Umesh Mishra, of Samaila village had recently filed a review petition mentioning that the accused was not found guilty under section 506 IPC by the court in Feb, hence proper order be passed against the two accused. The ADJ-III-cum-special judge, after hearing arguments from both sides, found the two partially guilty and fixed May 27 for further hearing and order. One Umesh Mishra accused them of assaulting him with an intention to kill and snatching money while he was on a morning walk. He was bleeding profusely from his head and went to Keopti PHC from where Umesh was referred to Darbhanga Medical College & Hospital (DMCH).
