Kuching waiter fined RM3,500 for threatening to kill sister, damaging property

KUCHING (June 9): The Magistrates' Court here today fined a waiter a total of RM3,500 in default two months in jail for threatening his sister and damaging her mobile phone.
Magistrate Ling Hui Chuan convicted Mohd Akhmar Fadzielawadie Juhdi, 25, on his own guilty plea to one charge of criminal intimidation, and another charge of committing mischief.
On the criminal intimidation charge framed under Section 506 of the Penal Code, the accused was fined RM2,000 in default one month in prison for threatening to kill his 26-year-old sister at a house in Kampung Segedup here at around 11.30pm on June 3, 2025.
On the second charge, the court fined Mohd Akhmar RM1,500 in default a month in jail for damaging her mobile phone on the same day, time and place.
Based on the facts of the case, the accused had asked his sister to contact his girlfriend to inquire about his work schedule.
She did as asked and relayed the girlfriend's message to him, that the work schedule was not yet available as the office management was still on holiday.
The response angered Mohd Akhmar, who asked his sister to call his girlfriend again so he could hear for himself her explanation. When she refused, he grabbed her mobile phone and smashed in on the ground.
Their father attempted to defuse the situation but the accused became increasingly aggressive, leading to a physical altercation.
While in the kitchen, he uttered death threats against his sister and father should any of them call the police.
Fearing for her safety and that of her family members, the sister lodged a police report, leading to Mohd Akhmar's arrest the following day.
