Apex court rejects habeas corpus bid by GISBH CEO, wife

PETALING JAYA : The Federal Court today rejected a habeas corpus application by Global Ikhwan Services and Business Holdings (GISBH) CEO Nasiruddin Ali and his wife Azura Yusof.
They had sought to challenge their detention under the Security Offences (Special Measures) Act 2012 (Sosma) after being charged with being members of an organised criminal group.
Sinar Harian reported that a panel of three judges chaired by Chief Justice Tengku Maimun Tuan Mat made the unanimous ruling after finding that the application had no merit.
'The High Court's decision is maintained,' said Tengku Maimun, who sat with Justices Abu Bakar Jais and Vazeer Alam Mydin Meera.
This means that Nasiruddin will remain in detention at Sungai Buloh prison. Azura meanwhile was previously released on bail by the Shah Alam High Court.
In their application, the couple had named the home minister, inspector-general of police, public prosecutor, Selangor and Kuala Lumpur prisons director, and the government as respondents.
The Johor Bahru High Court rejected their habeas corpus appeal on Jan 14, with Justice Abu Bakar Katar saying the two were under a legal detention warrant issued by the Selayang sessions court and not under Sosma.
In October last year, Nasiruddin, Azura and 19 others were charged at the Selayang sessions court with being members of an organised crime group at a premises in Bandar Country Homes, Rawang, between October 2020 and Sept 11, 2024.
They were charged under Section 130V(1) of the Penal Code, which carries a prison sentence of five to 20 years upon conviction. The case was later transferred to the Shah Alam High Court for trial.
