People with previous felony convictions are prevented from possessing guns or ammunition by federal law. Due to a previous felony conviction for two counts of delivery of a Schedule II controlled substance in Nicholas County Circuit Court on June 2, 2009, Martin knew he could not have a gun in his possession.
The announcement was made by Acting United States Attorney Lisa G. Johnston, who thanked the United States Forest Service and the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) for their work on the investigation.
