45-acre South Wexford farm for auction guiding at €16k/acre
Coming under the hammer on Tuesday, July 1, at the Ballinaboola Hotel outside New Ross in County Wexford is a 45-acre quality farm at Ballinruane – 16km to the south of the auction site. Young girl's ‘minder' took advantage of situation to sexually assault her while at house party
The now adult offender pleaded guilty to the offence, committed when he was aged 16, at a hearing of the Circuit Court in Wexford. The offence dated back to one night in 2020 when the pair were both present at a birthday party. A young man, who posed as protector of a young girl, used his self-appointed role as cover for sexual assault. New Ross-based Garda Owen Maher, who investigated the case, noted that some small amount of alcohol had been supplied to the party goers. Towards the end of the night, the accused approached the girl in the kitchen. He said he would stay with her and make sure that nothing happened to her. So he followed her as she lay down on a sofa in another room. She later reported drifting in and out of sleep, only to find the older boy's hand inside her underwear. When he did this a second time, she woke her boyfriend who had seen nothing of this activity. The matter was brought to the attention of the gardaí some time later. When the allegations were put to the defendant, he at first said he had been concerned for the girl, three years his junior. He suggested to gardai that she had been highly intoxicated and that he was concerned for her wellbeing. Garda Maher reported that the complainant stated that she had drunk some Bulmers that night, but not a lot. Eventually, the accused recognised his wrongdoing, pleading guilty and coming to court with a letter of apology for his victim. The defending barrister Barry Ward told Judge James McCourt how his client had already suffered consequences. With stories of what went on at the party circulating, he had been made a pariah by his peers. He had since suffered depression and anxiety but was now in employment, counsel stated. 'He understands the gravity of what has happened,' concluded Mr Ward. The judge addressed the injured party: 'You have done nothing wrong and should be able to walk out of here with head held high.' Turning to the defendant, he said the court could not accept that he had been acting as the girl's minder. Instead, he took advantage of the situation. The judge acknowledged that he was a child before the law at the time of the offence. A two-year prison sentence was suspended in full, with the name of the accused put on the sex offenders' register for six months.
