Advocates organizing to support immigrant families
( — Experts and advocates like immigration attorney Andrew Newcomb and First 5 California's Executive Director, Jackie Wong are telling Fox 40 how they are re-doubling efforts to support California immigrant families. Wong says that First 5 California started supporting migrant families fairly recently. 'A few years ago, when there was an Afghan refugee and asylee issue the California Children and Families Commission (First 5) decided to actually get involved in immigration because it was such a prevalent part of our lives,' says Wong 'We want to promote inclusion and really create the safe, stable, nurturing environment that is necessary for Californians to thrive.' Within the last five years they've been building up their resources and network to better support immigrant communities. One of the partners they've been working with to better equip immigrant families is immigration attorney Andrew Newcomb. Newcomb has a decade of experience in immigration law. He currently offers pro bono services to migrant families in the San Jose Mexican consulate while also hosting community workshops with First 5. We sat down with Newcomb for a Q&A for him to answer some of the most pressing questions when it comes to immigration. Here is some of his legal advice. Q: What does someone do if they are detained by ICE agents? A: 'It's best, of course, to not divulge information. You can just save those arguments for a judge that you're hearing, invoke your right to remain silent, and to speak with counsel,' said Newcomb. Q: What can someone working to obtain citizenship do if their family is of mixed status and their child is about to turn 21? A: 'There's a difference between people that came in typically with a visa or people that can benefit from a family petition prior to April 30, 2001. They can usually apply for residency here in the United States, whereas other folks may have to do a longer line which ultimately leads them to a consular office in their country of origin,' said Newcomb. Newcomb also clarified that there are defenses to deportation that are available for people who can prove they've lived in the U.S. for at least ten years and have immediate relatives who have lawful status. Q: Is someone's asylum hearing or application for citizenship different if they entered the country within the last two years? A: 'Yes. So this is basically an issue where they've expanded the definition of what constitutes an 'arriving alien' for the purposes of a process called expedited removal. When someone's in an expedited removal proceeding, they don't necessarily have the right to have their hearing heard before an immigration judge.' Newcomb also adding, 'What we're seeing here is that the government attorneys are attempting to have cases dismissed and then right after the cases are dismissed, provided the person can't prove that they've been in the United States for longer than two years, ICE officers are waiting to detain them and place them in expedited removal proceedings. However, even people whose cases have not been dismissed are also being scooped up by ICE agents, which of course creates an issue of overlapping jurisdiction, which still has to be resolved by the courts.' Q: What if someone is trying to obtain status legally, but fears arrest at one of their court hearings? A: 'It's very important for people that have been here for fewer than two years to take advantage of filing a motion to appear via video or filing a motion to continue your hearing until you're on the outside of those two years. Immigration judges here in Sacramento, just like in the Bay Area, are very receptive to those kinds of motions because at the end of the day, they want to do their jobs as arbiters of fact, and they don't want to have their cases just whisked away from them.' Newcomb says a video court hearing can increase safety while attending asylum proceedings. He was drafted in the first round, 15th overall, in the 2014 draft by the Los Angeles Angels, receiving a $2.5 million signing bonus. But the Angels traded him to the Braves a year later. Newcomb never reached the potential the Angels saw in him, spending six seasons in Atlanta, winning 24 games against 23 losses with a 4.25 ERA in 144 games, including 57 starts. Making the team out of spring training, Newcomb started the season in the Red Sox rotation due largely to injuries to starting pitchers Brayan Bello and Cutter Crawford. Boston moved Newcomb to the bullpen when Bello returned. Newcomb had an 0-4 record, but also compiled a 3.95 ERA, fourth-best of any pitcher on the Red Sox staff with at least 25 innings pitched. On Saturday, Newcomb pitched one relief inning in the first game of a doubleheader, allowing one run on one hit and one walk. But before the second game, the Red Sox designated the local player for assignment. With an overall respectable, though unremarkable, performance in his 11 games with the Red Sox, Newcomb is expected to catch on with another team in need of middle-relief or spot-starting help. Mary Newcomb (1922-2008) was a shy and self-effacing artist who spent most of her working life in the seclusion of rural East Anglia where her husband farmed. In 1970, she was discovered by the London dealer Andras Kalman, who staged her first exhibition at his gallery in smart, moneyed Knightsbridge. Kalman had an eye for art that blended sophistication and simplicity, typified by LS Lowry, and Ben and Winifred Nicholson, all personal friends whose work he sold to the rich and famous. In Newcomb's tender characterisation of farm animals, birds and bees, and in her humorous observations of country living, he found an artist who would appeal to his star-studded clientele. And in her work, they found an honest mix of truth and fantasy, a place of escape. Some of Kalman's best clients were in the film and theatre business, including directors Bryan Forbes (Kalman was a backer on the classic 1961 film Whistle Down the Wind, starring Hayley Mills) and Richard Attenborough. Many of these clients are known to have bought works by Lowry and Ben Nicholson, as well as Christopher Wood and Alfred Wallis, but less is known about who bought the Mary Newcombs. Last week, I visited an exhibition of her work at the Crane Kalman Gallery (Andras Kalman died in 2007, and it is now run by his son, Andrew) and encountered the Hollywood actress Jacqueline Bisset. Known for her appearances in films such as François Truffaut's Day for Night and Roman Polanski's Cul de Sac, these days Bisset lives in Los Angeles but also has a home near the Knightsbridge gallery and had lent a painting to the exhibition. 'Since about 1974, I have acquired 14 paintings and drawings by Mary Newcomb – it's like an addiction,' she told me. 'The work, with its lack of guile, goes straight to my heart. I find in Mary's work a place of peace, quiet and reflection as well as humour.' Looking through the Crane Kalman archives, it turns out that Bisset is not the only big name to have been persuaded by Newcomb's charms. Film stars Paul Newman, Julie Andrews and Rod Steiger, as well as Michael Parkinson and Cilla Black are among those who have bought her paintings. A recent disciple is Emma Thompson. Newcomb's paintings and drawings were never expensive – less than £100 in the early days and rising to £75,000 at her peak. Often compared to Winifred Nicholson, Newcomb's auction record (£32,500) lags far behind Nicholson's (£245,000), though in terms of a place in the hearts of Hollywood's finest, there is no question of who's on top.
