City of Elmira orders community fridge to be moved from sidewalk
ELMIRA, N.Y. (WETM) — Volunteers at the Elmira Community Cycle were asked by the City of Elmira to move the outdoor community fridge from its location on the sidewalk. The fridge was donated to the Elmira Community Cycle on Jan. 30 for people to donate food and provide for the community.
The community cycle received a notice from the City of Elmira Code Enforcement Department on Monday, Feb. 10, giving them 48 hours to remove it. Volunteer Coy Gobble told 18 News he spoke with the department on Tuesday morning for an extension to let the fridge remain on the sidewalk through Friday.

'We are forced to remove the fridge that's been used 24 hours a day. We've had hundreds of meals from multiple partners in the community come and disperse meals through this fridge, and it's been a very exciting thing to develop in the community to help anybody who needs a meal,' Gobble said.
Director of Code Enforcement John McCracken told 18 News that the volunteers can't have the refrigerator on the sidewalk because it violates the cities right of way policy.
According to Elmira ordinance code, 'Public right-of-ways, streets, lots. Notwithstanding any other local law or ordinance, no person shall place, throw, or deposit, or cause to be placed, thrown, or deposited, any miscellaneous refuse or obstructions of any kind upon any street or any portion of a public right-of-way, or publicly owned lot, except as may otherwise be permitted for solid waste collection purposes under L.L. No. 1992-1, as may be from time to time amended or superseded.'
Tara Escudero, a volunteer with Elmira Community Cycle, said that the fridge has been a significant development in helping those in need of a meal, and its removal is disappointing.
'To just see code enforcement come and not really be willing to work with us when there are fridges in other cities across New York State, the same type of fridges. It's just really disappointing,' said Escudero.
According to Escudero, a new location for the fridge is still uncertain.
