DOJ: De Lima's acquittal stands for now, CA only asked RTC to clarify ruling

The Department of Justice clarified that the Court of Appeals did not overturn former Senator Leila De Lima's acquittal in one of her drug cases. Instead, the appellate court merely remanded the Muntinlupa Regional Trial Court's decision for clarification. DOJ spokesperson Atty. Mico Clavano emphasized that this move does not constitute a reversal of De Lima's acquittal. 'This is not a reversal per se… it is more of a remanding of the decision to clarify the decision,' Clavano said. He added that the acquittal appears to remain in effect while the Court of Appeals reviews the case, as the other party still has the option to file a motion for reconsideration. De Lima earlier said she plans to appeal the CA ruling to the Supreme Court. Speaking on 'Balitanghali,' she questioned the basis of the decision, saying it seemed to criticize the RTC judge's manner of writing rather than ordering a retrial. 'It only says to fix the decision to comply with the constitutional standard of clarity,' De Lima said in Filipino. As the case returns to the Muntinlupa RTC, the Office of the Solicitor General said DOJ prosecutors will handle it in the lower court. 'The CA decision speaks for itself… the DOJ prosecutors will take it from there,' Solicitor General Menardo Guevarra told reporters. If the case reaches the Supreme Court, the OSG will represent the state. However, Clavano clarified that the DOJ's role in the case has largely concluded. 'Our prosecutors participated in the RTC proceedings, but under the law, the OSG takes over when a criminal case is appealed to the Court of Appeals,' he said. Clavano also stressed that De Lima is not a party to the certiorari petition filed by the OSG. Instead, the respondent is Judge Abraham Alcantara of RTC Branch 204, who previously acquitted De Lima and her former aide Ronnie Dayan. The certiorari questions alleged grave abuse of discretion on the part of the judge, not the merits of the acquittal itself.

SINGAPORE – With Polling Day coming up on May 3, two eateries have caught election fever and are rolling out tongue-in-cheek promotions. The first candidate is Cafe OSG at Suntec City, which has launched a new menu called 'Wok Wisely – A Makanfesto of SG Flavour'. It offers 11 dishes – each with its own political party-inspired name and accompanying symbol – such as The Dependable One Chicken Rice ($8.50), The Hardworking Hero Char Kuay Teow ($13.90) and The Comeback Kid Hokkien Mee ($15.90). Cafe OSG's owner Zach Wen, 41, is no stranger to putting a creative food spin on politics. In 2018, he dished out Harmony Nasi Lemak at OSG. This was during the Trump-Kim Summit, when United States President Donald Trump and North Korean leader Kim Jong Un met here. Mr Wen says: 'With the general election upon us and a record number of parties contesting, we decided to add a little local flavour to the occasion. Thus, 'Wok Wisely' was born. 'It's a playful yet meaningful nod to the season, featuring dishes that speak to Singapore's rich culinary soul.' Most dishes will remain on the menu, even after the hustings are over. Over at seafood restaurant Humpback in Bukit Pasoh Road, it is marking May 3 with its 'Oyster Polling Day'. From noon to 11pm, it will offer an 'all-day oyster happy hour' – with oysters priced at $2++ to $3++ each. These 'star candidates', says its press statement, are flown in fresh from Hama Hama Oyster Company, a sixth-generation family-run farm on Washington State's Olympic Peninsula in the US. Voting also takes place here – for one's favourite oyster varietal, that is. Diners will receive a ballot-style order sheet to cast votes with hourly updates provided as results will be tallied throughout the day. At the end of the day, one oyster will emerge victorious. The Department of Health & Human Services (HHS) appears to have taken down a webpage from the Office of the Surgeon General (OSG) that included an advisory on gun violence. In June 2024, then-U.S. Surgeon General Vivek Murthy issued an advisory declaring gun violence to be a public health crisis in America, calling for an evidence-based approach to public health change as well as a ban on assault weapons and large-capacity magazines for civilian use. "Firearm violence is an urgent public health crisis that has led to loss of life, unimaginable pain, and profound grief for far too many Americans," Murthy said in a statement at the time. MORE: About 11,600 people have died in US gun violence so far in 2024 The OSG issued a press release at the time showing that at least 10 national medical organizations -- including the American Medical Association, American Academy of Pediatrics, American College of Surgeons, American Public Health Association and the YWCA -- wrote statements in support of the advisory. However, the webpage where the advisory existed currently displays a "Page Not Found" message. "We're sorry, but there is no page that matches your entry. Possible reasons: The page may have been moved, it no longer exists, or the address may have been typed incorrectly," the website states, as of Monday. The White House did not immediately reply to ABC News' request for comment. In a statement to ABC News, the HHS said that the department "and the Office of the Surgeon General are complying with President Trump's Executive Order on Protecting Second Amendment Rights." Last month, President Donald Trump issued an executive order, directing the Attorney General to review "[a]ll Presidential and agencies' actions from January 2021 through January 2025 that purport to promote safety but may have impinged on the Second Amendment rights of law-abiding citizens." HHS Secretary Robert F. Kennedy Jr. has previously stated he believes in the Second Amendment but that he wants to determine the cause of mass shootings. Experts previously told ABC News there is no evidence to suggest that patients with mental health disorders, or those who are on medications for disorders, are more likely to be violent. Firearm-related injuries are the leading cause of death in the U.S. among kids and teens. Gun-related suicides have risen among all age groups from 2012 to 2022; the greatest rise has been among 10–14-year-olds, according to Murhty's advisory. Gun violence prevention programs, such as GIFFORDS -- which was founded by former Congresswoman Gabrielle Giffords -- criticized the Trump administration for the removal of the advisory. "By removing this important public health advisory with lifesaving resources, President Trump has chosen to prioritize gun industry profits over protecting kids and families," Emma Brown, executive director of GIFFORDS, said in a statement. "Guns have been the number one killer of American children and adolescents since 2020, and non-partisan health care experts have understood gun violence as a public health crisis for years."
