'A team of policemen attached to the Cubbon Park police stations visited all the pubs and restaurants in their jurisdiction and found 12 of them did not have designated smoking zones. The checks were made on Thursday and Friday late evening at Grant Circle, Vittal Mallya Road, UB City, Kasturba Road, Church Street, St Marks Road and Lavelle Road,' said an officer. FIRs have been registered against the manager and staff. As per the rules, if restaurants, hotels or pubs have a seating capacity of more than 30, then it is mandated to have a designated smoking zone. Even airports must compulsorily have designated smoking zones. In July, last year, the police had registered an FIR against the manager of One8 Commune for reportedly keeping the pub open beyond the permissible time limit. One8 Commune restaurant was started in December 2023, in Bengaluru. It is located on the sixth floor of the Rathnam's Complex on Kasturba Road in the vicinity of Chinnaswamy Cricket Stadium. It may be recalled that from May 27 to June 2, the city police intensified the enforcement of COTPA, 2003. The police gave special focus to enforcing the ban on Electronic Nicotine Delivery Systems (ENDS), including e-cigarettes and vaping devices. Surprise inspections were conducted at malls, coffee bars, and shops to check for violations related to having a designated smoking zone.

In July 2024, the same police station filed a case against One8 Commune and two other outlets for operating beyond the legally permitted hours. Former Indian cricket team captain Virat Kohli-owned One8 Commune pub in Bengaluru is facing legal trouble again, with the Cubbon Park police registering a suo motu case againsts the establishment for violating the Cigarettes and Other Tobacco Products Act (COTPA). The case was filed under sections 4 and 21 of COTPA for failing to provide a designated smoking area within the premises. In connection with World No Tobacco Day, observed on May 31, the Bengaluru police had recently carried out an awareness and enforcement campaign across the city. This is not the first time the pub has faced scrutiny. In July last year, a First Information Report (FIR) was filed against it for operating beyond permissible hours. As per the FIR, on July 6, 2024, One8 Commune pub was found operating at 1.20 am, although there is a rule that such establishments cannot operate beyond 1 am. Based on a complaint then, the Cubbon Park police station registered an FIR against the pub's manager under section 103 (penalty for contravention of Order 31) of the Karnataka Police Act. Order 31 deals with the power to make orders to regulate traffic and preserve order in public places. Similar action was taken against three other pubs at the time. In December last year, the Bruhat Bengaluru Mahanagara Palike (BBMP) issued a notice against the pub for running without a mandatory No-Objection Certificate (NOC) from the Fire Department.
