Poll code violation: HC bars action against SP MP
Prayagraj: No coercive action will be taken against Samajwadi Party MP from Moradabad, Ruchi Vira, in the criminal case of alleged violation of 2024 model code of conduct pending at Moradabad, ruled Allahabad high court.
FIR was lodged against her under section 188 (Disobedience to order duly promulgated by public servant) and 171-H (Illegal payments in connection with an election) of IPC.
Justice Samit Gopal passed the order in a petition filed by Ruchi Vira, booked for violation of model code of conduct by addressing a gathering at a house "without prior permission" during 2024 Lok Sabha election campaign.
Earlier, counsel for the applicants produced before the court an order dated Aug 22, 2024, passed in Pradeep Kumar Chaudhary Vs.
State of Uttar Pradesh and another and submitted that the question in the present matter was identical to that of the matters in which interim order had been passed. It was also submitted that present case be tagged with earlier cases and heard and interim protection be granted.
On the other hand, state govt counsel opposed the petition but could not dispute arguments raised by the applicant counsel.
The court said in its order, "In view of the same, connect it with criminal misc application under section 482 no- 26365 of 2024 (Pradeep Kumar Chaudhary Vs.
