MUMBAI: The Bombay high court on Monday directed the Panvel Municipal Corporation (PMC) to take steps to clean the holy Israel Lake next to the Jewish cemetery in Panvel. A division-bench of chief justice Alok Aradhe and justice Sandeep Marne gave this direction while listening to a plea by Jewish Heritage Trust, which had earlier alleged contamination of the lake due to sewage flow from surrounding encroachments. 'You are under statutory obligation to take steps for ensuring cleanliness. You cannot shy away from that,' the court said. The case pertains to a petition filed by the Jewish Heritage Trust, alleging illegal trespass and encroachment on land reserved for the Jewish community's burial rituals. The high court had earlier censured the Panvel Municipal Corporation (PMC) for its apathetic response to encroachments on a 200-year-old Jewish cemetery. The trust had claimed that the holy lake was being misused by encroachers for discharging drainage waste, and that an illegal slaughterhouse was operating within the encroached area. Furthermore, graves in the cemetery have reportedly been destroyed to facilitate these constructions. The Jewish Heritage Trust, through trustee Raymond Gadkar, stated that repeated complaints to the PMC since 2019 have gone unanswered. The Trust sought directives from the court to compel the PMC to act against the encroachments to prevent further damage. The high court has now directed the local body to survey the area and determine the extent of encroachment after listening to all stakeholders.

The Bombay High Court on Monday directed Panvel Municipal Corporation (PMC) to remove unauthorised or illegal constructions on land belonging to a 200-year-old Jewish cemetery. A bench of Chief Justice Alok Aradhe and Justice Sandeep V Marne was hearing a plea by Jewish Heritage Trust, filed through its chief trustee Raymond A Gadkar alleging that certain encroachments in the form of unauthorised hutments and hoardings are made on its land reserved for Jewish community's burial rituals and repeated complaints to PMC have availed no action. The Trust, through senior advocate A S Khandeparkar, claimed that despite ongoing proceedings before legal forums, the PMC has repeatedly failed to take any action against the alleged encroachers despite it having identified them. The plea also raised grievances over the discharge of waste generated through the encroachments into the holy Israeli tank/lake. The petitioner Trust, which was formed to manage and protect Jewish heritage sites, said the tank is used to wash/clean the bodies prior to their burial as per Jewish rituals. 'Undoubtedly, under the Maharashtra Regional Town Planning (MRTP) Act,1966 and Maharashtra Municipal Corporation (MMC) Act, 1949, the Panvel Municipal Corporation is under a statutory obligation to remove encroachment and to keep the water bodies clean,' the HC noted. The court noted that whether the alleged construction was raised on a plot belonging to Subhan Shah Dargah or on the designated cremation ground of the petitioner Trust was 'a question of fact,' which it could not determine under Article 226 of the Constitution. Therefore, the court directed the ward officer of PMC to all persons or parties who may be in occupation of the concerned land and then take action against structures/encroachments as per law and the said exercise be completed within three months. The HC clarified that it did not express any opinion on the merits of the matter and any person or party aggrieved due to demolition or removal action was at liberty to take recourse to the remedy prescribed under the law. The court then disposed of the plea.

Mumbai: Bombay high court on Monday directed the Panvel Municipal Corporation to take action against encroachments on a Jewish cemetery plot that includes a water tank for the ritual of cleansing bodies. A bench led by Chief Justice Alok Aradhe, while hearing a petition by the Jewish Heritage Trust, directed that the D ward officer should hear those who have put up the constructions or occupy it. If any person is found to be in unauthorised occupation or has raised any illegal construction, action shall be initiated for removal or demolition in accordance with the law. The exercise shall be completed within three months.

As many as 114 new COVID-19 cases were reported in Maharashtra, taking the count to 1,276 since January this year, while one more patient succumbed to the infection, pushing up the toll to 18, the state health department said on Friday. Of these cases, 44 were detected in Pune (42 in civic limits in two in rural areas), 37 in Mumbai and seven each in Mira Bhayandar and Panvel Municipal Corporation areas. They were followed by civic areas of Navi Mumbai (4), Pimpri-Chinchwad (6), Kalyan (3), Thane, Satara, Kolhapur, Sangli, Chatrapati Sambhajinagar and Parbhani (one case each), a health department statement said. The department has conducted 15,510 COVID-19 tests since January, of which 1,276 were reported positive, it said. One more patient has died since Thursday, taking the toll to 18. Of these, 17 patients suffered from comorbidities (simultaneous presence of two or more medical conditions), said the department. The neighbouring Kalyan-Dombivli Municipal Corporation (KDMC), in a separate release, said three new COVID-19 patients were detected in civic areas, taking the tally so far to 18. The death toll remained unchanged at three, it added.
