Actor Soubin Shahir gets anticipatory bail in ‘Manjummel Boys' cheating case
Kochi: Actor Soubin Shahir, his father Babu Shahir and Shawn Antony, the producers of the hit Malayalam movie 'Manjummel Boys', have been granted anticipatory bail by high court in a financial cheating case related to the film's production. The bench of Justice Bechu Kurian Thomas on Thursday held that custodial interrogation of the petitioners was not necessary, noting that the case involved elements of a commercial dispute. However, HC granted limited custody of the petitioners to facilitate the investigation and directed them to appear before the investigating officer on July 7 and 8 for interrogation. The officer may interrogate them between 10am and 5pm, and in the event of arrest, they shall be released on bail, the court ordered. The case stems from a complaint filed by Siraj Valiyathara of Aroor before the Ernakulam magistrate court, alleging that Parava Films LLP, owned by the accused, had solicited his investment for the production of 'Manjummel Boys'. As per an agreement dated Nov 30, 2022, he invested a total of Rs 7 crore through multiple transactions. While considering the anticipatory bail plea, HC observed that the relationship between the parties primarily falls within the realm of a business transaction and that the resulting dispute lies in the commercial sphere. However, since another single bench had already declined to quash the proceedings, the court noted that it cannot be treated as a purely commercial dispute and acknowledged that an element of criminality appears to exist. Based on this, and after considering the need for custodial interrogation, the bench granted anticipatory bail to the petitioners.

Kochi: The police have informed high court that actor Soubin Shahir, his father Babu Shahir and Shawn Antony, all three accused in the alleged financial cheating case related to the production of the hit Malayalam film Manjummel Boys, must necessarily be interrogated in police custody. The investigating officer, Maradu police station house officer Rajesh R, made this submission in response to the anticipatory bail pleas filed by the accused. The case originates from a complaint filed by Siraj Valiyathara of Aroor before the magistrate court, Ernakulam, alleging that Parava Films LLP, owned by the accused, had solicited his investment for the production of Manjummel Boys. In its report, the police vehemently opposed the pre-arrest bail pleas, contending that the investigation so far revealed a deliberate attempt by the accused to cheat the complainant. It was alleged that although the film grossed Rs 286 crore, the accused failed to pay Siraj his rightful profit share amounting to Rs 40 crore. According to police, the accused paid Siraj only Rs 5.99 crore, and that too only after HC, relying on the police report indicating commission of a cognizable offence, issued a directive in that regard. Previously, in May 2024, the court had stayed the investigation upon petitions filed by the accused. However, on May 22, 2025, the court dismissed those petitions, thereby allowing the investigation to resume. Pursuant to this, the police issued notices directing the accused to appear before the investigating officer on June 20. However, HC deferred their appearance to June 27 in light of their pending anticipatory bail pleas. The police have prayed for the dismissal of the bail petitions. The matter is posted for consideration on June 26.

In March 2025, high court had disposed of the petitioners' earlier pre-arrest bail pleas in view of a stay on the proceedings granted in a related petition. However, the court subsequently permitted the police to resume the investigation. Following this, the police issued fresh notices for interrogation, prompting the petitioners to file a new bail application.

The case originated from a complaint filed by Siraj Valiyathara of Aroor before the judicial first-class magistrate court, Ernakulam. Siraj alleged that Parava Films LLP, owned by the petitioners, had approached him for investment in the movie. Pursuant to an agreement dated Nov 30, 2022, he claimed to have invested Rs 7 crore in multiple instalments. Despite the film becoming a commercial success, Siraj alleged that he was not paid the agreed share of profit. Based on the magistrate court's direction, the Maradu police registered a case. In their petitions, the producers countered that it was Siraj who had breached the agreement by failing to invest the promised amount on time, which disrupted shooting schedules and caused significant financial loss. They contended that Siraj was, therefore, not legally entitled to a share of the profits. The officer also stated that, unlike other investors and financiers, Siraj alone had not been repaid. Considering these facts, the bench emphasised that the cheating case against the petitioner cannot be quashed, since the consideration at this stage is limited to whether the allegations in the FIR disclose the commission of a cognizable offence. Accordingly, the court dismissed the petitions.
