California Democrat will not face DUI charges after negative drug test
SACRAMENTO, California — State Sen. Sabrina Cervantes will not face DUI charges stemming from a Sacramento collision after a drug test showed the lawmaker was not intoxicated at the time of the incident. The Sacramento County District Attorney's Office on Friday announced a blood test the Riverside County Democrat took on the day she was involved in an accident near the Capitol was "negative for any measurable amount of alcohol or drugs." "We have reviewed of all the submitted evidence, including police reports, witness statements, and laboratory results," the DA's office wrote in a statement. "Based on our ethical duty and the burden of proof in a criminal trial, the Sacramento County DA's Office declines to file any charges in this case." Sacramento police cited Cervantes with a DUI after she went to the hospital following the collision on the afternoon of May 19. She strongly denied she was intoxicated, saying police "accosted" her at the hospital. Police later said they suspected the senator was under the influence of drugs, not alcohol, when they cited her. Cervantes produced the results of her own urine test taken the day after the collision that showed she had undetectable levels of drugs in her system. The DA's office previously said prosecutors were waiting for the results of the blood test to determine whether to charge the senator.
