Railways held accountable for injury to doctor at Ajmer stn

1 2 Ajmer: The district consumer dispute redressal commission in Ajmer has ordered the railways to pay compensation of Rs 60,000 in a case where a doctor at JLN Hospital was injured when stepping down from the train where there was no platform at Ajmer railway station on April 10, 2016. The incident resulted in the doctor sustaining multiple fractures and being bedridden for six months. The railways responded to the incident by stating that the passenger intentionally stepped down from the coach where there was no platform. The commission found this to be a major negligence on the part of the railways in providing safety and security to passengers. The incident involved Dr Sanjeev Maheshwari, a physician from Ajmer and a professor at JLN Medical College. "Maheshwari had returned from Delhi to Ajmer via the Yoga Express. When he stepped down at Ajmer junction, there was no platform as the second AC coach was at the end, causing Maheshwari to fall and sustain injuries," said Surya Prakesh Gandhi, Maheshwari's advocate. The doctor underwent surgeries and remained bedridden, which prevented him from treating patients at JLN Hospital. "He lodged a complaint with the railways but the railways replied that passengers should step down from the coach where there is a platform. by Taboola by Taboola Sponsored Links Sponsored Links Promoted Links Promoted Links You May Like 3/4 BHK from ₹ 1.68 Crore*, Bengaluru Birla Estates Learn More Undo They claimed passengers jumped from the coach without looking outside, thus absolving the railways of responsibility," added Gandhi. He further mentioned that the railways suggested the victim was not a consumer of the railways and should approach the railway claims tribunal. The matter was taken to the district consumer dispute redressal commission, which determined that they had the right to hear the case as the passenger had paid for the railways' services. Chairman Arun Kumawat, along with members Dinesh Chaturvedi and Jaishri Sharma, passed judgment on June 6. They directed the railways to pay Rs 25,000 as compensation and Rs 10,000 for mental harassment, with an interest of 9 percent from Nov 22, 2016, the day the complaint was filed. Additionally, they were ordered to pay Rs 25,000 to the welfare account of the consumer commission.
