Toney man convicted of capital murder in wife's shooting death denied new trial, acquittal
HUNTSVILLE, Ala. (WHNT) — A Toney man who was convicted of capital murder in the shooting death of his wife was denied a new trial and an acquittal on Tuesday.
According to court documents, 50-year-old David Tolbert's attorney filed the motion for a new trial and acquittal on June 9. However, a circuit judge denied the requests on June 10.
He was originally charged with the capital murder of his wife, Savannah, who died on Nov. 15, 2022. The Huntsville Police Department initially thought her death was a suicide, but as the investigation continued, they ruled it a homicide, and her husband was charged on Dec. 9, 2022. She was 37 at the time of her death.
He was sentenced to life in prison without the possibility of parole on May 8.
