Kozhikode: Five of the six students accused in the Shahbaz murder case were granted Plus One admission following the directions of the high court. Three students were admitted to the Thamarassery govt vocational higher secondary school while the two others secured admission to two schools in Kozhikode. The high court had directed the superintendent of the observation home in Kozhikode where the students are staying to take necessary steps to facilitate the admission of the students, observing that right to admission of students should not be curtailed. Student organisations including KSU and MSF staged protest before the Thamarassery GHSS over the admission of the accused students. They were arrested and removed before the students were brought to the school for seat allotment process. The court heard the bail application of the six accused students and has reserved the judgement. Mohammmad Shahbaz, a student of the MJ higher secondary school, was assaulted using a nunchaku (a martial arts weapon) during an altercation at a farewell function at a tuition centre on Feb 28. He succumbed to the injuries the next day at the Kozhikode govt medical college hospital. Thamarassery Police had booked the students under murder charges. The accused students were allowed to write the SSLC examination while they were at the Vellimadukunnu observational home. Father of Shahbaz said that granting of Plus One admission to the accused students gives a wrong message.

Kochi: HC on Wednesday directed the superintendent of the Observation Home at Kozhikode to take necessary steps to facilitate the admission of the five accused students in the Shahbaz murder case, to Class XI. Justice Bechu Kurian Thomas also instructed the station house officer of Thamarassery police station to provide adequate protection to the accused if their physical presence is required at the schools. The order came while considering petitions filed by the accused as part of their bail applications, seeking permission to complete the admission process for Class XI. The petitioners submitted that they had secured admission in three different schools, and that June 5 is the last date for enrollment. Observing that the petitioners' right to education should not be curtailed, particularly since their bail applications had already been heard and judgment reserved, the court directed the superintendent to take appropriate steps to facilitate their appearance for the admission process. The petitioners shall be granted liberty from 10am to 5pm on Thursday under the personal bond of both their parents, if required, the court added. According to prosecution, the accused allegedly assaulted Mohammed Shahbaz, a Class X student of M J Higher Secondary School, Kozhikode, using a deadly weapon following a minor altercation during a farewell function at a tuition centre on Feb 28. Shahbaz was allegedly attacked with a 'nunchuck' and subjected to repeated punches and kicks, resulting in a severe skull fracture. The 15-year-old boy succumbed to his injuries the next day at the Govt Medical College Hospital, Kozhikode. The accused were later arrested. Meanwhile, the accused students passed the SSLC examination, qualifying them for higher secondary education, prompting the present applications.

LAHORE: The Lahore High Court (LHC) held that right to information (RTI), does not extend to any legitimate privacy interest and request for provision of information can validly be withheld which violates the privacy of an individual. The court passed this order in an Intra Court Appeal (ICA) of a citizen Shahbaz who challenged the verdict of a single bench which set aside a decision of Punjab Information Commission directing the Excise & Taxation Department for provision of the information asked by the appellant. The court said the appellant made request for getting information qua disclosures of names of taxpayers and information regarding individual properties owned by different taxpayers but imparting of requisite information is subject to an unambiguous consent of said individual otherwise request could validly be regretted under section 13(1)(b) of the Act, the court added. The court said that the single bench has rightly allowed the constitutional petition of the respondent department; however, the Punjab Information Commission passed the order in blatant excess of its jurisdiction, the court added. The court dismissed the ICA in limine and burdened the appellant with special cost of rupees one million. It observed that the amount should be recovered as decree in favour of the respondent department. The court said the right to information is primarily intended to give access to the citizen to the information gathered and maintained by public authorities to ensure that government is functioning in a transparent manner and accountable to the people it serves. The court; however, observed that the privacy directly relates to an individual's personal life, such as his name, address, phone number, family details, medical history, financial status; etc. which has validly been safeguarded in almost every law, the court added. Mohammad Shahbaz lost his parents when he was barely two years old. On Friday, after collecting the best batsman's trophy in the boys' category in the third edition of the UTCA Chandigarh Police Gully Cricket Tournament, Shahbaz (18) of Team 187, while celebrating with his teammates, remembered his parents Mohammad Lateef and Zehrunnissa. The trophy was given by Chandigarh Administrator and Punjab Governor Gulab Chand Kataria at Punjab Raj Bhavan on Friday. A student of Government Model Senior Secondary School, Sector 19, and fan of Virat Kohli, Shahbaz, currently drives a rented auto in Bapu Dham apart from managing his studies, to support his dreams. 'I was two years old when I lost both my parents to illness. I was raised by my maternal grandmother Jainab at our native village in Gonda district in Uttar Pradesh and had come to Chandigarh eight years ago to stay with my maternal uncle. Later in 2019, I shifted staying alone and training in cricket under various coaches. Early this year, I started driving an auto to support myself. I dedicate this trophy to my parents,' said Shahbaz while speaking with The Indian Express. The youngster had been training under UT coach Harish Sharma in 2022 at the Government Model Senior Secondary School, Sector 32. He competed in the first edition of the UTCA Chandigarh Police Gully Cricket Tournament in 2023 and was part of the runner-up Team 53 scoring more than 200 runs in the tournament. This year, Shahbaz scored 254 runs and took 11 wickets in the tournament. While he will be trained by UTCA for further training, the youngster will also be returning to drive his auto post his school and training to support himself. 'I have been training under Harish sir and also play local tennis ball matches. Most of my free time is spent driving the auto to support my training and other expenses. To be selected by UTCA for further training will motivate me to improve further,' the 18-year-old said. The cricketer had also saved money to watch his idol Virat Kohli play for Royal Challengers Bengaluru against Punjab Kings in an IPL match at Mullanpur last month. 'I save money to watch Virat play. Hopefully the team will win the play-offs matches here and I will try to get a ticket for the matches at Mullanpur. Kochi: High court on Tuesday orally questioned the state govt and general education department's action in withholding the SSLC examination results of six students accused in the Kozhikode Mohammed Shahbaz murder case . While considering the bail pleas of the accused, Justice Bechu Kurian Thomas asked the authority under which the state govt had withheld the results. "Publishing the result is entirely different from the offence committed. If they have written the examination, the results have to be published. Does the state have the power to debar a person simply because he is involved in a crime? The entire concept of criminal jurisprudence is based on reformation, especially when the offender is a child in conflict with the law… The offence is not connected to the examination. So, how can the state govt refuse to publish the results," the court asked. According to prosecution, on Feb 28, during a farewell function at a tuition centre, the accused allegedly assaulted Shahbaz, who was also a Class X student of M J Higher Secondary School, Kozhikode, with a deadly weapon following a minor altercation. It is also alleged that he was attacked with a 'nunchuck', and was repeatedly punched and kicked, resulting in a severe skull fracture. The state maintained that the commission has only recommendatory powers. He further pointed out that Tuesday was the last date for applying for Plus One admission through the single window system, and the accused had been in detention for more than 80 days. However, the single bench refrained from interfering in the matter of non-publication of the students' results, stating that it does not fall within the scope of bail jurisdiction. The court requested the petitioners to approach the writ court for appropriate relief. Additionally, the court directed the police to produce the case diary in connection with the bail pleas and adjourned the petitions to Wednesday.
