Surat: Case lodged against dismissed ACP over ‘fake' caste certificate

Days after an Assistant Commissioner of Police (ACP) in Surat city, B M Chaudhary, was dismissed from his duties following an order by the State Home Department in this regard, a police complaint has been registered under the Gujarat SC/ST Act against the former at Umra police station, officials familiar with the matter said on Monday. Chaudhary has been accused of submitting a fake caste certificate of Scheduled Tribe (ST) at the time of recruitment for the post of police sub-inspector in 1993. Chaudhary was due to retire on June 30. The case was registered against Chaudhary based on a police complaint registered by the Social Welfare Department — which falls within Surat District Panchayat Department — officer Mukesh Gamit. On May 20, the State Home Department had sent an order copy regarding Chaudhary's dismissal to the Surat police commissioner on May 20. Following this, the Deputy Commissioner of Police, Zone 5, R P Barot, gave Chaudhary the letter. According to the first information report (FIR), 'Praveen Parghi, president of Adijati Vikas Trust, Godhra, had sent a written complaint to Deputy Secretary of Gujarat Takedari Ayog (Gujarat Vigilance Commission) in Gandhinagar on October 7, 2024, stating that ACP B M Chaudhary, serving in Surat city, obtained a fake Schedule Tribe certificate to get a job and promotion in the Gujarat police department. The commission should check and verify the certificate submitted by Chaudhary…' Based on Parghi's letter, the State Vigilance Department ordered the Gujarat Police's State Vigilance Cell to launch a probe into the matter. 'The state vigilance (department) had ordered the Gujarat Police, State Vigilance Cell, to probe the issue and submit a report in 10 days. The vigilance cell officials, meanwhile, wrote to ACP Chaudhary to submit his school leaving certificate, age proof, father's school leaving certificate, grandfather's age proof, brothers' and sisters' school leaving certificates, and pedigree of his family,' said the FIR. According to the FIR, 'The commission had written 15 times to ACP Chaudhary in 2024 seeking the documents concerned, but he delayed the process, seeking more time. Seeing no response from Chaudhary, the State Vigilance Department ordered the Surat Social Welfare Officer to register an offence against Chaudhary.' Acting on the statements of Social Welfare Officer Mukesh Gamit, Umra police registered a case against Chaudhary under the Gujarat State Schedule Caste Schedule Tribe and Other Backward Classes (Regulation of Issuance and verification of Caste certificates) Act 2018 Section 12 (1)(a) (… obtaining a false caste certificate. It states that anyone who obtains a false caste certificate by providing false information, filing false statements or documents, or using any other fraudulent means will be punished), 12(1)(b) (…use of a false caste certificate to gain benefits or admissions reserved for SC, ST, or OBC. It states that anyone who is not a member of those communities but uses a false caste certificate to secure benefits, appointments, or admissions reserved for them will be punished.) Confirming the development, Umra Police Inspector J A Rathwa told The Indian Express, 'We have registered a case against B M Chaudhary for submitting a fake Schedule Tribe caste certificate to get appointment and promotion in the Gujarat police services. Chaudhary had appeared in the police recruitment exam in 1990 and submitted the certificate. Later, he used the same certificate to get promoted.' 'We have sent our teams to his house in Kukarmunda taluka in Tapi district. We are also checking the places of his relatives and friends in connection with the probe,' said Rathwa further. Meanwhile, Chaudhary remained unavailable for remarks over the matter.
