Bersatu's RM195 million bank account freeze stays, court rules
KUALA LUMPUR: Parti Pribumi Bersatu Malaysia's (Bersatu) bank account containing RM195 million will continue to be frozen pending the outcome of two judicial review applications and related criminal proceedings, the High Court ruled recently. Judicial Commissioner Gan Techiong made the ruling in CIMB Bank's application seeking a court declaration on whether it should maintain the freeze on the account or release the funds following conflicting instructions from the Malaysian Anti-Corruption Commission (MACC) and Bersatu's executive secretary, Datuk Muhammad Suhaimi Yahya. The bank filed the interpleader application after receiving a letter of demand from Suhaimi seeking the release of the funds, which were deposited into the party's account by Bukhary Equity Sdn Bhd. CIMB, as the sole plaintiff, named the MACC, the public prosecutor and Suhaimi as defendants. Gan said the dispute could not be resolved summarily, as the issues raised were already the subject of pending judicial review proceedings and a criminal trial involving former prime minister and Bersatu president Tan Sri Muhyiddin Yassin. "The disputes between the defendants are not suitable to be determined summarily by this court in hearing the bank's interpleader. "They are questions of law and disputed facts forming the subject matters of the judicial review applications at the Special Powers Division of this court and the aforesaid criminal prosecution at the Sessions Court – all of which are still pending hearing and trial, respectively. "If this court is to delve deeper, the effect would be to usurp the domain of other courts that ought to be making the final determination on a wider range of issues," he said in his ground of judgment dated April 9 this year. He said Muhyiddin had been charged in March 2023 in his capacity as Bersatu's president over funds allegedly received by the party, which fulfilled the requirement under Section 52A of the Anti-Money Laundering, Anti-Terrorism Financing and Proceeds of Unlawful Activities Act 2001 (AMLA) to sustain the seizure order on the account. Gan said a society like Bersatu does not have a separate legal personality, as the law allows charges to be brought against its office bearers. The court said in this case, the president (Muhyiddin) was charged in relation to the very funds in question. The court also rejected a late 376-page affidavit filed by Suhaimi's lawyers, saying it was inadmissible as it was filed without leave of court and at a very late stage of proceedings. "The fact that such a lengthy affidavit was filed at the eleventh hour reinforces my view that the matter is not suitable to be summarily determined in this interpleader." Gan then ordered CIMB to continue holding the funds until the High Court's Special Powers Division disposes of the judicial review applications filed by Muhyiddin and Suhaimi, which are still pending. The first judicial review challenges the legality of the freezing order issued by MACC in January 2023, while the second seeks to quash the seizure order issued by the public prosecutor in April of the same year. Leave to proceed with both reviews was granted last year, but the substantive hearings have yet to take place. Muhyiddin is facing four charges under the MACC Act and two under AMLA involving a total of RM200 million, including RM195 million allegedly transferred into the Bersatu account held with CIMB Islamic Bank. Lawyers Sathya Kumardas and Daud Sulaiman appeared for the bank while senior federal counsel Nurhafizza Azizan and federal counsel Mohammad Salehuddin Md Ali represented the MACC and the public prosecutor. Bersatu was represented by lawyers Chethan Jethwani and Tang Jia Yearn.

Suhaimi rebukes Joniston

Kota Kinabalu: Libaran MP Datuk Suhaimi Nasir has hit back at Gabungan Rakyat Sabah (GRS) Information Chief Datuk Joniston Bangkuai, accusing him of hypocrisy and political betrayal. Suhaimi was responding to Joniston's criticism of Sabah Umno Chief Datuk Seri Bung Moktar Radin, who had recently said it would be difficult to work with GRS again due to past betrayals. 'What I saw wasn't a mature political argument, but a childish attack from someone who seems to have forgotten his own political roots,' Suhaimi said in a statement. He reminded Joniston that his political career began under Barisan Nasional (BN), through PBS when the party was part of the coalition. 'You were nobody in Sabah politics if not for the BN platform. It wasn't your brilliance but the strength of BN that lifted you,' he said. Suhaimi criticised PBS's record, pointing out the party's multiple exits and re-entries into BN, calling it a pattern of opportunism. He also questioned Joniston's silence during the January 2023 political crisis, saying he only took a stand after it was clear who would remain in power. 'Don't act self-righteous. GRS politics today is not built on moral strength but the moral weakness of others,' he said. Suhaimi said it was disingenuous for Joniston to now talk about rejecting cooperation with BN in the name of principle when he had once stood at the frontlines of BN victories. 'You left BN when times got tough – that's a fact you can't spin,' he said. 'Sabahans are not blind to history. They know who stood firm and who only showed up when there was something to gain. 'Don't make loyalty a joke. Bersatu distorted facts over Banggi solar project - MP
Suhaimi KOTA KINABALU (May 27): Libaran Member of Parliament Datuk Suhaimi Nasir has slammed Sabah Bersatu for politicising the hybrid solar energy project on Banggi Island, accusing the party of distorting facts to gain 'cheap political mileage.' In response to recent claims by Bersatu Sabah Women chief Rahimah Majid who demanded clarification from Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi on the project, Suhaimi said her accusations were baseless, misleading and ignored the actual circumstances surrounding the project. 'Her allegations are not grounded in facts and are sensational in tone. They not only confuse the public but also expose Bersatu's lack of understanding regarding the technical details of the project,' Suhaimi said in a statement on Tuesday. Suhaimi clarified that the Rural Electrification Supply Project (BELB) for a hybrid solar system on Banggi Island had in fact been fully completed in 2015, long before Zahid assumed leadership of the Ministry of Rural and Regional Development (KKDW). 'The project was handed over to Sabah Electricity Sdn Bhd (SESB) for operation and maintenance. Any technical problems after the handover fall under SESB's responsibility — not KKDW's,' he stressed. He also noted that the villages named by Rahimah, Kampung Selamat, Pulau Tigabu and Pulau Balambangan, fall under a separate ongoing project: the Hybrid Solar System for Remote Islands of Sabah, which is currently 85% completed, with a delay of 349 days or 15 percent behind schedule. 'The KKDW Technical Division is in the process of terminating the contractor due to failure to meet both deadlines and standards. A follow-up site inspection is scheduled for June 16, 2025. This shows the government is taking clear and transparent action,' he said. Suhaimi also took issue with Rahimah's claim that the project was launched with great fanfare but later abandoned. 'That's a deliberate attempt to create a false narrative to distract from the real issue — the inefficiencies of the current state administration under GRS, which once included Bersatu,' he said. He further pointed out that the very projects now being criticised were initiated during Bersatu's own time in government. 'It is ironic. They inherited and implemented these projects, but now they want to blame others. This is not only irresponsible, but a complete embarrassment in terms of political integrity,' he added. Calling on Bersatu Sabah to stop 'barking from the sidelines,' Suhaimi urged the party to engage constructively and 'step into the arena to solve actual problems.' 'Sabahans are smart enough to see through political gimmicks. They know who delivers and who disappears when responsibility needs to be carried,' he said. 'Politics should be based on facts, not slander.' The Banggi Island solar project has recently drawn public scrutiny following concerns about delays and implementation setbacks in several remote villages. Suhaimi's remarks come as the federal government continues to monitor and enforce project accountability across rural Sabah.

Banggi solar project completed in 2015, says Sabah Umno leader
KOTA KINABALU: A Sabah Umno leader has refuted claims by Bersatu regarding stalled solar projects in Pulau Banggi, labelling them misleading and politically motivated. Sabah Umno information chief Datuk Suhaimi Nasir said the accusation by Sabah Bersatu women's chief Rahimah Majid showed a lack of understanding about the project's implementation. "This project was fully completed in 2015, long before Zahid (Deputy Prime Minister Datuk Seri Dr Ahmad Zahid Hamidi) led the Rural and Regional Development Ministry,' Suhaimi said in a statement. Concerns were raised last Saturday (May 24) over stalled hybrid solar projects in Pulau Banggi, which remained incomplete years after their launch. Rahimah urged the Federal Government to explain the delay, stating that the failure has dashed residents' hopes of reliable electricity. Accessible by a ferry ride of over one hour from Kudat, the island hosts many coastal villages facing challenges accessing electricity and clean water. Suhaimi, also the Libaran MP, said the Rural Electricity Supply (BELB) Hybrid Solar Project was handed over to Sabah Electricity Sdn Bhd (SESB) for operation and maintenance. He added that any technical issues since then fall under SESB's jurisdiction and said that the the villages mentioned by Rahimah—Kampung Selamat, Pulau Tigabu and Pulau Balambangan — are part of a separate initiative. This project, Hybrid Solar System Project for Remote Islands in Sabah, is 85% complete, with a 15% delay from the original timeline. "The ministry's technical division is terminating the contractor for failing to meet deadlines and standards," he said, noting a site visit is scheduled for June 16. "This shows the government is taking firm and transparent action on the delay." He said Rahimah's claim that the project was launched "in grand fashion" but is now abandoned was a baseless attempt to twist public perception. "What's ironic is this was a legacy project from their own time in government. Now they point fingers at others," he said. Suhaimi said Bersatu Sabah should stop acting like "a frustrated commentator barking from the sidelines" and focus on real solutions. "Sabahans are wise enough to judge who walks the talk and who only makes promises when in power, then disappears when it's time to deliver," he added.

Nizam rebukes Suhaimi over emotional rhetoric and unanswered RM7.5 billion question
Nizam KOTA KINABALU (May 19): Assistant Minister to the Chief Minister of Sabah, Datuk Haji Nizam Abu Bakar Titingan, has issued a firm rebuttal to recent comments by Libaran member of parliament Datuk Suhaimi Nasir, accusing him of being overly emotional and ignoring key issues of public accountability. Nizam thanked Suhaimi for what he described as 'closely monitoring' his actions, suggesting that his name still held enough influence to provoke strong reactions. 'Clearly, my name carries enough weight to elicit an angry and emotional tone — a sign that the truth, however bitter, unsettles those with vested interests,' said Nizam. In response to Suhaimi's remark urging him to 'look into the mirror,' Nizam retorted, 'Sometimes the mirror itself is cracked, and what one sees is merely the shadow of unresolved political grudges. Perhaps that is why he fails to distinguish between fact and sentiment.' The Apas assemblyman acknowledged his past involvement in government but dismissed any accusation of hypocrisy. 'I do not deny once being part of the government, and I do not hide my record. The difference is, I did not reappear after two decades of silence pretending to be as pure as a white cloth. I continued to serve and stay with the people — not just re-emerge to shape perceptions,' he said. Nizam also took issue with Suhaimi's reference to being 'grateful to Umno,' calling such a mindset outdated. 'I am unsure if he is still trapped in 1990s-style politics, where positions were seen as party gifts instead of a mandate from the people. I wish him a speedy recovery from that nostalgic delusion,' he added. He criticised Suhaimi for indirectly casting aspersions on current Sabah cabinet members, who he said were working together to rectify mistakes made by previous leaders, including those from Umno. 'This is a textbook example of spitting into the wind,' Nizam remarked. Central to Nizam's response was a demand for accountability regarding the RM7.5 billion in federal funding for basic infrastructure projects during the Umno-led administration. 'My question remains unanswered: What happened to the RM7.5 billion in basic infrastructure funds during the Umno era? So far, it has only been met with emotion, not data.' Nizam concluded by calling for mature leadership and constructive contributions. 'Sabah does not need politicians who get offended when criticized. Sabah needs those who can accept criticism, work quietly, and deliver results — not long essays filled with metaphors, sarcasm, and nostalgia for lost seats.' 'If Datuk Suhaimi and the current Sabah Umno leadership truly wish to change and leave behind the burdens of the past, then start by contributing — not attacking. And if dramatics are necessary, at least ensure the script is logical and the characters are not contradictory.' Nizam currently serves as the Information Chief of Parti Gagasan Rakyat Sabah, a component of the Gabungan Rakyat Sabah government.
