Delhi HC rejects bail plea of Vedpal Singh Tanwar in PMLA case linked to illegal mining in Haryana

New Delhi [India], June 10 (ANI): The Delhi High Court on Monday rejected the interim and regular bail pleas of Vedpal Singh Tanwar in a money laundering case. He is an accused in a case linked to illegal sand and stone mining in the Dadam area of Haryana. The High Court dismissed the bail plea in view of the material placed on record by the Enforcement Directorate (ED). Justice Girish Kathpalia dismissed the bail plea after hearing the submissions of the ED and material placed on record. Justice Kathpalia said, 'I am unable to satisfy myself that there is any reasonable ground for believing that the accused/applicant is not guilty of the offences alleged. That being so, the rigours of Section 45 of the PML Act dissuade this court from admitting the accused/applicant to bail on merits.' After perusing the medical status report of May 2, 2025, which compiled medical reports of hospitals including AIIMS, the bench rejected the interim bail plea of Tanwar. 'According to the said Medical Status Report, the accused applicant is stable and regularly reviewed by the doctor on duty, and all medicines prescribed by AIIMS are being provided to him from the jail dispensary itself. So, on that count also, the accused/applicant has failed to establish a ground for grant of bail,' Justice Kathpalia said in the order passed on June 9. While rejecting the bail pleas, the High Court said that there was a huge loss of Rs 78 crore to the government exchequer. The court noted that the documentary record reflected the unlawful gain to the accused persons, including Tanwar, and the unlawful loss to the exchequer to the time of Rs 78,14,75,324. Justice Kathpalia also said that no serious health issue decipherable from the Medical Status Report received from the jail, 'I find it not a fit case to release the accused/applicant on bail. The applications (for regular as well as for interim bail) are dismissed.' The bail pleas were opposed by ED's special counsel Zoheb Hossain. Special counsel Zoheb Hosain for ED, while opposing the bail plea, had submitted that the accused is not in long incarceration as he was admitted in the interim bail and was in the hospital for a considerable time. There is a 165-day effective incarceration only. He is medically fit. An FIR was registered in August 2023 at Tosham. ECIR was registered in September 2023. Tanwar was Arrested in May 2024. ED's counsel argued that the alleged offences under section 420 (Cheating) and section 120B (Criminal Conspiracy) were part of the ECIR. There is illegal stone mining in this case. Allegations of cheating are there. Fraudulent representation was made to government as Tanwar was blacklisted by the Haryana government, Zoheb Hosain said. His firm Ridhi Siddhi was blacklisted by the Haryana Government. He was not allowed to participate in mining auctions. He was blacklisted, he can't bid, Hossain added. Hussain further argued that Tanwar did it through another firm, Goverdhan Mining and Mineral (GMM). Tanwar was controlling the affairs of that firm. He was the CEO of GMM and drew a salary of Rs 10 lakh per month. On the other hand, senior advocate Vikas Pahwa advanced rebuttal arguments for Tanwar. He submitted that Cognizance is not taken against Tanwar. Prima facie, there is no Offence against him. NGT order is set aside. FIR is pending. The special director of ED becomes the complainant, she is the informant, the senior advocate added. Tanwar has moved a plea through advocate Sumer Singh Boparai and Aman Sharma. ED had arrested Ved Pal Singh Tanwar under the provisions of the Prevention of Money Laundering Act (PMLA), 2002, on May 30, 2024, in connection with illegal mining in the Dadam area of Haryana. As per ED, it initiated an investigation on the basis of the Prosecution Complaint filed by the Regional Officer, Haryana State Pollution Control Board, Bhiwani, before the Special Environment Court, Kurukshetra, against the Firm M/s. Govardhan Mines and Minerals for violating the conditions of Environment Clearance under the Environment (Protection) Act, 1986 and subsequently, an FIR was registered by Haryana Police under various sections of IPC, 1860. ED said that the investigation revealed that the firm had been involved in large-scale illegal and unscientific mining in the Dadam area of Haryana. It had led to large-scale damage to the environment and a huge loss to the exchequer. It is worth mentioning here that rampant illegal mining in the area led to the killing of five persons due to landslides, ED said in a press note. (ANI)

New Delhi [India], June 9 (ANI): The Delhi High Court on Monday reserved an order on Vedpal Singh Tanwar's bail plea after hearing submissions from counsel for the petitioner and the Enforcement Directorate (ED). The court said it would pronounce the order today. Tanwar is an accused in a money laundering case linked to illegal mining in the Dadam area of Haryana. Justice Girish Kathpalia reserved the order after hearing the arguments advanced by Advocate Zoheb Hossain, Special Counsel for ED and rebuttal arguments by Senior Advocate Vikas Pahwa. Special Counsel Zoheb Hosain for ED, while opposing the bail plea, submitted that the accused is not in long incarceration as he was admitted on interim bail and was in the hospital for a considerable time. There is a 165-day effective incarceration only. Hosain submitted that Tanwar is the mastermind in this case. He is not sick and infirm. As per the AIIMS report, he is perfectly fine. In his case, the twin conditions of PMLA squarely apply. ED's counsel opposed the submissions made by the counsel for the accused, saying that no offence was made against him as the Environment Protection Act was decriminalised. ED argued that excessive mining began in February 2019. There was excessive sand and stone mining by the accused persons in this case. Zoheb Hossain argued that the Punjab and Haryana High Courts have not issued an order quashing the FIR or the present ECIR. An FIR was registered in August 2023, and ECIR was registered in September 2023. Consequently, Tanwar was arrested in May 2024. ED's counsel argued that the alleged offences under section 420 (Cheating) and 120B (Criminal Conspiracy) were part of the ECIR. 'There is Illegal stone mining in this case. The Supreme Court has re-emphasized that bail matters should not be delayed even for a day, as they concern citizens' liberty. 'We have time and again emphasised the importance of the liberty of citizens. There should not be a single day's delay in deciding liberty of citizens in bail matters,' said a bench of Chief Justice of India Bhushan R Gavai and Justice AG Masih on Thursday as it heard one Vedpal Singh Tanwar's bail plea filed in a money laundering case. Tanwar's lawyer, senior advocate Vikas Pahwa, said the bail plea was pending in the Delhi high court for over a year. He added that no effective hearing has occurred as either the case gets adjourned, or the Enforcement Directorate (ED), probing the matter, seeks time, or the roster gets changed. 'It is a vicious circle. After we argue, ED takes time to respond and the roster gets changed,' Pahwa said. The Supreme Court said that Justice Girish Kathpalia, who is hearing the matter at the high court, will be holding a vacation bench and directed placing of the matter before him on June 9. Additional solicitor general Aishwarya Bhati, appearing for the ED, told the Supreme Court that Tanwar presented an incorrect picture. She added he has been on interim bail for 212 days since his arrest. Bhati said Tanwar was jailed for 115 days and hospitalised for 38 days after a gallbladder operation. She blamed Tanwar for the delay by taking adjournments. Bhati said the matter could not be heard on some occasions due to judges' recusal. The court noted the submissions in its order and asked the high court to decide the matter expeditiously after hearing both sides. Tanwar was arrested for alleged illegal and unscientific mining in Haryana's Dadam and causing losses to the exchequer. The ED said unaccounted ₹26.45 lakh cash, jewellery worth Rs. 3.7 crore, among other valuable possessions, were recovered from Tanwar. The ED has accused his firm of illegally acquiring over ₹37 crore from the illegal mining activities and investing the proceeds of crime in movable and immovable properties.

Gurgaon: A woman lost Rs 80,000 after a man allegedly replaced her debit card inside an ATM of the SBI near Old Railway Road on the pretext of helping her withdraw money on Friday. Seema Tanwar, a Yamunanagar resident, currently residing in a rented accommodation in Shivpuri, told police that she went to the said ATM to withdraw Rs 5,000 around 5pm on Friday. However, even after she withdrew the said amount, she could not reset the details of her transaction on the machine, and it was still active on the screen. It was then that she sought the help of a man present at the ATM. Tanwar said that the man somehow replaced her debit card in a fraction of a second and handed over another debit card to her, and when she swiped it, she assumed her transaction was finally over. However, two messages late at night, confirming the deduction of Rs 80,000 from her account, using the card, made her realise the fraud. She informed the police the next morning. A case was registered against an unidentified person under sections 318(4) (cheating and inducing the delivery of property or causing the making, altering, or destruction of a valuable security), 303 (theft) of BNS.

Haryana woman loses Rs 80k after man swaps debit card inside ATM

Representative Image GURGAON: A lady lost Rs 80,000 after a man replaced her debit card inside an ATM of SBI bank near Old Railway Road on the pretext of helping her withdraw money on Friday. The victim, Seema Tanwar, a Yamuna Nagar native and currently residing in rented accommodation in Shivpuri, Sector 7, Gurgaon, told police that she went to the said ATM to withdraw Rs 5,000 around 5 pm. "Even after withdrawing Rs 5,000 from the ATM, when I failed to come out of my transaction ID, I sought help from a man present in the ATM. He somehow replaced my debit card in a fraction of a second and handed over another debit card to me," Tanwar told police in her complaint. The victim realised the fraud after she received two messages late at night about the deduction of Rs 80,000 from her bank account using her debit card. She informed the police the next morning, following which New Colony police reached the spot and checked the CCTV installed inside and near the said ATM to trace the suspect. Police, however, booked an unidentified person under sections 318(4) (cheating and inducing the delivery of property or causing the making, altering, or destruction of a valuable security), 303 (theft) of BNS.
