Allegedly pulling a gun during an argument earns man a felony charge

May 29—A 22-year-old accused of pulling a gun on an acquaintance during an argument in Kalispell in early May is now facing a felony charge in Flathead County District Court. Prosecutors brought Jay Ryan Kaufman up on one count of assault with a weapon following the alleged May 9 confrontation on Fourth Avenue West. He is expected to appear before Judge Paul Sullivan on Thursday for his arraignment. Neighbors reporting a disturbance possibly involving a gun summoned Kalispell Police officers to the Fourth Avenue West home about 11 p.m., according to court documents. The victim told investigators that Kaufman had driven him home that night and, on the way, the two began arguing. As the victim got out, Kaufman fetched a handgun and leveled it at him, court documents said. Seeing the firearm pointed at him, the victim began apologizing before begging and pleading for his life, according to court documents. Another individual at the home told officers that they spotted the two arguing near Kaufman's truck. They reported trying to intervene when they saw Kaufman pull out the weapon, according to court documents. When authorities later tracked down Kaufman, he acknowledged getting into an argument while driving around with the victim. But he disputed assertions he wielded a gun in the disagreement, according to court documents. Kaufman allegedly told officers he owned a Taurus 9 mm handgun, and said it was stored in a safe in his home during the alleged confrontation. Investigators, though, found a black Taurus 9 mm handgun in Kaufman's truck, court documents said. Kaufman was convicted in 2022 of misdemeanor negligent endangerment in Flathead County District Court for pulling a knife on a parking attendant working a lot for patrons of the Northwest Montana Fair and Rodeo that same year. Initially charged with felony assault with a weapon, Kaufman later took a plea deal. Judge Amy Eddy, who presided over that case, sentenced him to the county jail for 180 days, all suspended. She also ordered Kaufman to undergo an anger management assessment, participate in any recommended counseling, and pay court fines and fees totaling $325. MOBILE, Ala. (WKRG) — A Mobile man has been sentenced to two years in prison after being found in possession of a gun as a convicted felon. (Photo courtesy of the Mobile County Sheriff's Office) The USDOJ news release said officers saw marijuana on Busby's lap and watched him drink from a bottle of prescription-only promethazine syrup — an allergy medication — and swallow marijuana during the traffic stop, the release said. Officers then searched Busby's car and found a loaded Taurus 9 mm pistol, a loaded extended magazine, a digital scale and other items, the release said. According to the release, the pistol they found had been reported stolen to the Daphne Police Department by its original owner in December 2022. Busby told police the gun was his, and he'd heard it was stolen and might have been connected to a homicide, the release said. He also told authorities that he was a convicted felon. At the time of his arrest, Busby had prior felony convictions for robbery and burglary, which made his possession of the pistol illegal under federal law. The Bureau of Alcohol, Tobacco, Firearms and Explosives; and the Mobile Police Department investigated the case. May 5—GRAND FORKS — A Grand Forks teen waived his Monday, May 5, preliminary hearing and pleaded not guilty to numerous felony charges, including five counts of attempted murder, while his codefendant's hearing was moved to next month. Mason Wyatt Allery, 17, is accused of firing multiple rounds at and into a vehicle on Jan. 3, among other weapons-related crimes. Allery and his codefendant, Walker Michael Poitra, face the same 13 charges: five counts of Class A felony attempted murder of a child, five counts of Class C felony reckless endangerment showing extreme indifference, Class C felony terrorizing a child, Class A misdemeanor criminal mischief and Class A misdemeanor unlawful possession of a handgun by a minor. Class A felonies have maximum 20-year sentences. Allery and Poitra's cases were originally filed in juvenile court, but were transferred to adult criminal court in March. Poitra remains in custody on a $1 million cash or surety bond. His preliminary hearing was rescheduled for 9 a.m. June 20. There is no public court filing regarding bond in Allery's case. The Herald reached out to the prosecutor and the clerk's office, but did not hear back from the latter in time for publication. Grand Forks police were dispatched just before 11 p.m. Jan. 3 to the area of 1000 North 42nd Street for a report of gunshots, according to an affidavit of probable cause filed in the case. Police alleged that they located a teal Taurus 9mm handgun near the area where Allery was apprehended. Allery and Poitra are accused of firing multiple rounds at and into a vehicle that was occupied by five minors, causing two to sustain injuries that were not life-threatening. Allery is also accused of showing a girl a handgun and displaying the bullets to prove it was real, as well as pointing it in her direction during a confrontation.

BINGHAMTON, N.Y. (WIVT/WBGH) – A Binghamton man appeared in Broome County Court for sentencing last week. District Attorney Paul Battisti announced that 23-year-old Dekwaun Hicks was sentenced to six years in New York State prison, followed by three years of post-release supervision for Attempted Criminal Possession of a Weapon in the Second Degree. On June 26, 2024, members of the Broome County Special Investigations Unit Task Force and the Binghamton Police Department's Community Response Team conducted a vehicle stop in the area of Varick Street in the City of Binghamton after receiving information that Hicks was in possession of a firearm. Officers recovered a loaded Taurus 9mm handgun and additional ammunition as well as methamphetamine pills from the vehicle. According to the District Attorney, Hicks was originally expected to receive a three-year sentence, followed by two-years post release supervision. However, prior to sentencing and while out on bail, he was arrested and charged with Criminal Possession of a Controlled Substance in the Third Degree, resulting in the enhanced sentence. 'This case sends a clear message: those who endanger our community by illegally possessing firearms will face serious consequences,' said Battisti. 'Public safety demands accountability, and our office will continue to act decisively against illegal gun possession and drug-related offenses.' FREDERICK COUNTY, Md. (DC News Now) — A man is facing various drug, firearm and theft charges after a woman allegedly found him inside her vehicle Wednesday, according to the Frederick Police Department. Police said a woman called stating a random man was inside her car, parked in the 500 block of North Bentz Street, smoking a cigarette. Victims lost over $700,000 after computer pop-up alert schemes in Prince George's County When confronted, he ran, and police began searching the area. Officers found a man in the area matching the description, and the woman positively identified him. Carl Terrace Mobley Jr., 42, was arrested, and a search of his person resulted in the seizure of suspected crack cocaine, a digital scale, cash, and a loaded Taurus 9mm handgun. Mobley is charged with: Theft from a motor vehicle Possession of a controlled substance with intent to distribute Firearm possession with a felony conviction Possession of a controlled substance – not cannabis Theft less than $100 Rogue and vagabond Handgun on person A loaded handgun on person Firearm/drug trafficking crime Distribution of a controlled substance with a firearm Mobley was transported to the Frederick Adult Detention Center, where he remains without bond.
