According to The New York Post, when the incident happened, Martin was speaking about the withdrawal of his nomination to be the permanent U.S. attorney to Newsmax on May 8, 2025. Fox News host Jeanine Pirro was nominated instead to be U.S. attorney for the Washington D.C. district. It appeared the woman was simply walking past when she spotted Martin because she was also walking a dog. "You are Ed Martin," the woman said before spitting on him. "You are a disgusting man," the woman also shouted. Martin looked shocked in the video as the incident unfolded. According to The New York Post, after concerns were raised about his nomination, it was decided that he would be an associate deputy attorney general and pardon attorney instead. Martin's nomination to be U.S. attorney failed after Republican North Carolina senator Thom Tillis indicated he would not back him, which would mean there were not enough votes in the U.S. Senate to get him through, according to Newsweek. Newsweek noted that the woman also used an expletive during the incident, which occurred while Martin was appearing on The Chris Salcedo Show. In January, Martin was named the interim U.S. attorney.

Tillis was concerned that Martin previously provided legal representation to defendants charged with crimes related to the January 6, 2021, riot at the U.S. Capitol.
