'Find out who will miss her and when': New documents released in Titusville murder

Earlier this week, Eyewitness News told you about the State Attorney's Office's intent to seek the death penalty in the case against a former Brevard County corrections deputy. David Barber is charged with the kidnapping and murder of 72-year-old Jessie Kirk. Barber was the ex-boyfriend of Kirk's niece. Now, new documents from the State Attorney's Office provide new insight into the crime. Investigators said they located a notepad during their investigation of Barber. According to investigators, the notes begin with investment plans and include a buy-and-gather list. Among the items on that buy list were a costume, trash bags, gloves, bleach and a sprayer, a plastic box with a lid, big zip ties, a hat, and wigs. The notes also included a timeline with instructions like: 'plan route, go to local bank, park across the street, observe, put on a disguise, and find out who will miss her and when.' One line read, 'Access finances if possible'. And at the end of that timeline, 'When leaving after sweeping house after bleaching place K's fingerprint on the toilet lid.' 72-year-old Kirk was reported missing on March 4. A friend helped Titusville Police locate Kirk's Lincoln SUV across the street from her Somerset Riverfront Condo at the Apollo Landings Apartments. By the time Kirk's niece arrived, Kirk's Lincoln was gone, but her niece recognized Barber's vehicle, and police were called again. They set up surveillance in the area, and when Barber arrived, police say he had a large injury on his right arm consistent with a burn from high heat, his hair appeared to be singed, and his shirt appeared to be partially burned. When police located Kirk's remains near the Haulover Canal, they were burned. The medical examiner's office listed Kirk's death as homicidal asphyxiation with terminal immolation. Florida woman claims Titusville tax preparer stole her return: ‘I'm distraught'

The Brief A Titusville mother alleges that a tax preparer stole her $10,000 tax refund by filing her return with incorrect bank information, leaving her unable to access her funds. Frustrated by the lack of transparency and unresponsiveness from the preparer, she has filed a police report while the Titusville Police investigate the alleged theft. The Better Business Bureau warns that not allowing clients to review tax documents and promising expedited refunds are red flags, particularly for those in financial distress. BREVARD COUNTY, Fla. - FOX 35 investigates alleged tax theft in Titusville. A mother says a tax preparer took her return and now can't be found. What we know She's out thousands as Titusville Police start to investigate. The woman, Katie Estremera, says she started getting the runaround about where her $10,000 return was and when she would receive it. That's when Estremera decided to call the IRS herself to check in. That's when she was told her refund had already been deposited. The problem is it didn't go to her account, and that's when she filed a police report. "I'm distraught. I don't know what to do, where to turn to," said Estremera. She's devastated after filing her taxes but never getting her return. "My babies' socials, my socials, my husband. I mean, at the end of the day, I'm suffering because I don't have any of these, no funds to cover what needed to be fixed," said the mother. The mom of two says she sent her and her husband's W2s and personal information to a tax preparer they used last year and didn't have any issues with. But after she filed this year, she struggled to get answers. "She kept telling me she didn't know where it was or what was going on, so I started really digging into everything," said Estremera. Estremera says she was not allowed to review her return before it was filed. But when she got the documents back and started reading them, she realized the bank routing and account numbers weren't hers. When she asked the preparer, Estremera says the preparer told her to "disregard all of that." It's been weeks, and she's now working with Titusville police to track down her money. "I'm waiting in limbo trying to fix all this stuff with police reports and IRS documentation and just trying to get my money back," she said. What they're saying The Better Business Bureau says the first issue was the fact that this consumer says she couldn't review the documents before they were filed. "If they will not allow you sufficient time to review it yourself, that should be considered a red flag," said Holly Salmons, CEO of the Better Business Bureau of Central Florida. The consumer expert also says you should avoid any tax preparer that promises large refunds, fast returns, or won't show you their credentials. In messages shared with FOX 35 by Estremera, the preparer also allegedly told her she would print the check and give it to her. That's another potential problem. "There is really no reason that the refund should go to your preparer," said Salmons. "It should either be direct deposited to you or the check should be sent directly to you." What we don't know FOX 35's Esther Bower spent all day calling, emailing, texting, and even going to the tax preparer's address. No one has responded yet. Police are investigating, and FOX 35 confirmed a case report was taken. So far, no one has been arrested. FOX 35 is not naming the tax preparer because no one has been charged at this time. This mother says she's now behind on her bills. The BBB says people in financial binds are often the victims of theft or scams because they need the money desperately. We confirmed with Cheney via email the police investigation was ongoing regarding the alleged tax theft. We also spoke with the alleged victim, Katie Estremera, on 2/27/25 to gather her information regarding what happened to her refund.

What we know Titusville Police Chief John Lau provided these new details via a pre-recorded statement posted to Facebook Thursday. Chief Lau said he was releasing more details to combat "misinformation" spreading on social media. Police had released very few details before Thursday. Initially, Titusville Police stated that officers arrived at the scene of a "suspicious incident" at 9:15 p.m. Feb. 7 in the area of Robbins Avenue in Titusville. As officers arrived on scene, one officer witnessed someone attempting to exit the home out of a back window and moments later Charles appeared at the front door. He allegedly attempted to jump over other people trying to exit the home and then tripped, causing a gun to fall out of his waistband. The officer that was located near the front door immediately yelled "He has a gun" several times, according to Chief Lau. Charles allegedly "rushed" at the officer, causing him to take a step back. Charles then picked up the gun that had fallen from his waistband and shots were fired by police, the chief said. "This incident is truly a tragedy. Anytime we deal with the loss of life, it is tragic for the family, community and our law enforcement officers", Chief Lau said. What they're saying On Tuesday, a city council meeting was shut down due to protesters calling for Titusville Police Chief Lau to be fired. "Fire that narcissist called Chief John Lau," said Robin Dennis, a protester who made public comments at the city council meeting. The victim's mom also attended the meeting, begging for answers. "I haven't seen my son body at all since he been murdered by TPD, no answers," said Samantha Charles. RELATED: Protestors shut down Titusville City Council meeting, after officer-involved shooting kills man The mayor of Titusville is standing behind the police chief and says he has full faith in John Lau. Mayor Andrew Connors does not support removing him from his position, despite people asking for that at the heated city meeting. "Titusville has been through this before, and he has been utmost transparent," stated Mayor Connors. Samantha Charles, mother of Tri-Marea Rayquan Charles, said she doesn't understand what happened, because her son was "not that type of kid." She said she feels pain and hurt, and she wants justice for her son. "He's lovable, respectable, and he (didn't) bother (anybody)," she said. The backstory Police Chief Lau provided a history of the address, 490 South Robbins Avenue, stating that the location dealt with an increase for calls of service over the past year. Calls included drug sales, fights, stolen vehicles and shots-fired calls. The home has also been a subject of many complaints from residents in the neighborhood. Complaints which include statements of people bringing assault-type rifles in and out of the home. According to Chief Lau, approximately 10 to 20 shots-fired calls at the home were responded to by police in the two weeks prior to the officer-involved shooting. A search warrant for drugs and firearms was served at the home on Wednesday, February 5, 2025. 16 individuals were detained in the 900 square foot home. Drugs and one firearm were seized during the search. The Florida Department of Law Enforcement is going to investigate the officer-involved shooting, which is standard procedure. Titusville will then open its own internal investigation. Both officers have been placed on paid administrative leave, which is also standard procedure.
