Final defendant pleads guilty in Harrison Twp. shooting, robbery
Apr. 17—The third and final defendant in a Harrison Twp. armed robbery where a man was shot in the back in November has pleaded guilty. Crystal Carpenter, 35, pleaded guilty to one count each of aggravated robbery and felonious assault in Montgomery County Common Pleas Court Wednesday. A second felonious assault and aggravated robbery charge were dismissed. She is scheduled to be sentenced on April 30. Around 4:26 p.m. on Nov. 30, Montgomery County sheriff's deputies responded to Miami Valley Hospital for a shooting victim. The victim said he met Carpenter in the 2400 block of Rugby Road to sell her marijuana, according to Vandalia Municipal Court records. "After completing the transaction, two males approached his vehicle with guns drawn and robbed him of his black Nike bag," an affidavit read. The men reportedly dragged him out of the vehicle and shot him in the back as he ran away. His brother was in the area, but did not witness the shooting, and took him to the hospital. Video footage from the area showed a Chevrolet Impala pulling up to the man's car and a woman getting out to make a transaction before getting back into the car, according to court records. The Impala then pulls out of view and two males approach from that direction with guns drawn. The video captured the pair dragging the man out of his vehicle and taking his bag before shooting him as he ran away, according to the affidavit. The pair then fled in the Impala. Around 8:30 p.m., deputies located the Impala and attempted a traffic stop on North Dixie Drive near Bartley Road, but the car fled. Tire deflation spikes were used in the 5400 block of North Dixie Drive and the Impala came to a stop near Republic Drive, according to court records. Carpenter, as well as two co-defendants, Jermaine Harbor and Jerrell Harbor, were detained. Jermaine Harbor was sentenced to four years and nine months to six years and three months for aggravated robbery, failure to comply and having weapons while under disability, according to court records. Jerrell Harbor was sentenced to four to six years for a felonious assault and aggravated robbery conviction.

Man shot at Harrison Twp. Kroger pleads guilty to misdemeanor
Feb. 27—A man who was shot by security while he was reportedly stealing from a Harrison Twp. Kroger on Halloween pleaded guilty to a lesser charge Wednesday. Jesus Hurtado-Gutierrez, 23, pleaded guilty misdemeanor theft and was sentenced to 180 days in jail, according to Montgomery County Common Pleas Court records. He was credited with 119 days served. Once he finishes his sentence he will be deported back to Mexico. Hurtado-Gutierrez was in the U.S. on a Visa and didn't leave the country after it expired, according to the Montgomery County Prosecutor's Office. Hurtado-Gutierrez was previously indicted on aggravated robbery and robbery, both felony charges. The aggravated robbery charge was dismissed and the robbery charge was amended to misdemeanor theft. He was shot multiple times at the Kroger at 3520 W. Siebenthaler Ave. on Oct. 31. Montgomery County sheriff's deputies responded to the store around 8:31 a.m. for a reported shooting. They arrived to find Hurtado-Gutierrez on the ground near the west entrance. Security guards told deputies they confronted Hurtado-Gutierrez after he came into the store and started stealing items, according to Vandalia Municipal Court records. Hurtado-Gutierrez reportedly became aggressive and threatened the guards. "(Hurtado-Gutierrez) then displayed a handgun toward the security guard as he was walking out of the store, at which time (a guard) who already had (their) firearm drawn, fired several shots and struck Hurtado-Gutierrez," an affidavit read. The security guard is from a third-party company that contracts with Kroger. Hurtado-Gutierrez was taken to the hospital with serious but non-life-threatening injuries. At least one of the security guards was wearing a body camera that captured the incident. Deputies reviewed footage that reportedly showed security confronting Hurtado-Gutierrez and telling him to leave. He was holding a drink in his left hand and had his right hand in his pants. As Hurtado-Gutierrez was leaving the store, he removed a gun from his pants and raised it toward a guard, according to municipal court records. One of the guards then fired. No other injuries were reported. "In reality we were very lucky that the security officer did not hit anybody else or that the suspect did not hit anybody," Montgomery County Sheriff Rob Streck said.

New video shows deputies trying to save people from a fire they say was intentionally set. [DOWNLOAD: Free WHIO-TV News app for alerts as news breaks] The fire occurred at an apartment complex in the 4100 block of Camargo Drive in Harrison Township around 3:40 a.m. As previously reported by News Center 7, a woman called 911 reporting that her boyfriend sent her pictures of himself setting her clothes on fire. Chaunsay Tinsley was arrested and charged with two counts of aggravated arson, according to Vandalia Municipal Court records. Body camera video shows deputies spot smoke and flames while walking to Tinsley's apartment. Police looking for man accused of stealing from local store Deputies knocked on Tinsley's door. 'I'm good,' Tinsley responds through the door. 'Alright, well can you let us in to check, we see like smoke dude,' a deputy responds to him. Tinsley continues to refuse to leave his apartment as the smoke gets thicker and spreads around the building. Deputies eventually try to kick down the door. After being unable to kick in the door, deputies change their priority to getting all other residents out of the building. Deputies return to Tinsley's apartment where they give him one last warning and he comes out still saying there is no fire and tells deputies to 'relax.' They handcuff him and lead him down the stairs. 'Really it's not on fire, it's smoke from the fireplace,' Tinsley tells deputies as he walks to a cruiser.
