Supreme Court dismisses Delhi Wakf Board's claim over Shahdara Gurdwara
NEW DELHI: Bringing curtains over a 50-year-old dispute relating to Delhi Wakf Board's claim over a Delhi gurdwara as waqf property, the Supreme Court on Wednesday said the Sikh religious place has been in existence since 1947 and rejected the Board's claim that the property was 'wakf by user' since time immemorial. Appearing for the Board, senior advocate Sanjay Ghosh told a partial working day bench of Justices Sanjay Karol and Satish Chandra Sharma that the Delhi HC erred in reversing the concurrent findings of trial court and appellate court that it was a wakf by user. He said, 'some kind of gurdwara was built over the mosque'. But the bench said the evidence shows that the gurdwara at Shahdara has been functioning at the suit property since 1947. 'Not some kind of gurdwara was constructed as you claim. It is a functional gurudwara. This has been admitted by the witness produced by the Board before the trial court. You should voluntarily relinquish any claim over gurdwara.' The bench dismissed the appeal filed by the Board in 2011 against the Delhi HC's Sep 24, 2010, judgment. The Lahore HC had ruled, "In the absence of any such intention or declaration, no wakf can be said to have been created. It is true that a wakf can be created by user, but that user too must be preceded by an intention on the part of the owner to create a wakf. If no such intention is established, user alone will not be sufficient to divest the property of its private character." A stand which is similar to that of the Centre in defence of validity of the Wakf Amendment Act, 2025, before the Supreme Court. In the Shahdra gurudwara case, the HC had said the oral and documentary evidence establishes that the disputed property was a private property. 'There is no evidence forthcoming to substantiate the Board's claim that there was a permanent dedication of this property by the owner as waqf; there is not a whisper of this either in the pleadings or in the oral version of the witnesses (produced by the Board).' 'A mere bald statement in the plaint that this property was being used since time immemorial as a wakf property was not sufficient to establish this plea… in fact there is a admission by a witness that the said property was used as a gurdwara since partition of the country,' the high court had said.

VCK to organise ‘Save Secularism' rally on June 14 in Tiruchi
Viduthalai Chiruthaigal Katchi has rescheduled its protest rally labelled 'Save Secularism' calling for a repeal of the Wakf Amendment Act, which was recently passed in the parliament, from May 31 to June 14, to give themselves time to mobilise their target of 'at least 5 lakh' people in Tiruchi. While the party leaders have said that the protest rally is being held in order to safeguard secularism in tune with its ideological position of opposing Hindutva forces, many admit that larger secular parties are impacted by the Hindutva political narrative that secular parties often privilege the interests of the minorities at the expense of the interest of the majority. Speaking at a press conference in Cuddalore, VCK president and Chidambaram M.P., Thol. Thirumavalavan, said, 'Apart from calling for a repeal of the Wakf act, the 'blue shirt' rally would also protest against BJP's attack on Constitution urging democratic forces should come together on one platform. I hope that all democratic forces join the 'Save Secularism' rally.' He once again said that the VCK continues to be in the DMK alliance. VCK general secretary D. Ravikumar, added that the party has significantly accommodated minorities within the party. 'All parties should provide more representation to Muslims. We have given one seat for a Muslim candidate (Aloor Shanavas) out of 6 seats allotted to us though our Muslim support base is not significant. We have accommodated them as office bearers and also as district secretaries,' he said. Asked if VCK would give more tickets to minorities in upcoming State Assembly elections, he said, 'If senior partner allots seats to us, we will accommodate more minorities and women.'

Supreme Court slams ‘irresponsible' Nishikant Dubey, but spares him from contempt
NEW DELHI: Supreme Court on Thursday tore into BJP MP Nishikant Dubey for his "irresponsible, absurd and scandalous" statements that imputed motive to the CJI-led bench for entertaining petitions challenging the Wakf Amendment Act , but displayed broad shoulders by ruling every contemptuous act need not result in punishment. Deciding not to initiate contempt proceedings against Dubey for his reckless allegations attempting to denude the dignity of the SC, a bench of CJI Sanjiv Khanna and Justice Sanjay Kumar said, "At the same time, we are of the firm opinion that courts are not as fragile as flowers to wither and wilt under such ludicrous statements. Justifying that it was duty bound under the Constitution to hear petitioners, who have a fundamental right to challenge the validity of the Wakf Amendment Act, the bench said though it is not entertaining plea for initiation of contempt proceedings, "any attempt to spread communal hatred or indulge in hate speech must be dealt with an iron hand". Innovative protest opposing Wakf Act today
Vijayawada: Muslim Personal Law Board Andhra Pradesh members Muhammad Ishaq and Maulana Syed Zakir Ahmad Rashadi have announced that a symbolic protest will be held on April 30 in the state opposing the Wakf Amendment Act. A meeting of Muslim organisations was held in Vijayawada on Tuesday and the leaders decided to oppose the Wakf Amendment Act. The representatives of the Muslim organisations participating in the meeting said the Waqf Amendment Act was unconstitutional and it must be revoked. They announced that a symbolic protest will be held on April 30 where lights will be turned off for 15 minutes from 9:00 pm to 9:15 pm to oppose the Waqf Amendment Act. State level meeting was held in Vijayawada following the call given by the All India Muslim Personal Law Board under the slogan Protect Waqf - Save the Constitution. During the meeting, discussions were held on protest strategies, guidelines, and the roadmap against the Waqf Amendment Act. The state level meeting was attended by Muhammad Rafiq, AP Movement Campaign Convener, Advocate Mukhtar, Maulana Mufti Yusuf, Maulana Naseer Ahmad, Maulana Mastan Sharif, Muneer Ahmad, AP JAC Convener and others.
